Pursuant to due call and notice thereof, a regular meeting of the City
Council of the City of Plymouth, Minnesota was held on the 2nd day of
March , 1987. The following members were present:
Mayor SchneiUeF, Councilmembers Crain, Sisk, Vasiliou, and litur
The following members were absent: none
Councilmember Zitur introduced the following Resolution and moved
its adoption:
RESOLUTION NO. 87-168
REQUEST FOR PAYMENT NO 13 AND FINAL
NIAGARA LANE STREET IMPROVEMENT PROJECT - PROJECT NO. 509
WHEREAS, the City of Plymouth as owner and C.S. McCrossan, Inc. as contractor
have entered into an agreement for the Niagara Lane Improvement Project, City
Project No. 509, said agreement being dated May 22, 1985; and
WHEREAS, the engineer has certified his acceptance of the work and his approval
of the final request for payment:
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA:
1. That the original contract amount was $1,032,062 and approved
Change Order of $38,512.28 were added making the revised contract
amount $1,070,574.28; and the value of work to date is
$1,017,795.73.
2. That the work performed by the contractor for the Niagara Lane
Street Improvement Project and certified to the Council by the
engineer as acceptable be and the same is hereby released from the
contract except as to the conditions of the performance bond, any
and all legal rights of the owner, required guarantees and
correction of faulty work after final payment.
3. Request for Payment No. 13 and Final in the amount of $90,968.35 to
G.S. McCrossan, Inc. for the Niagara Lane Improvement Project is
hereby approved and the City Finance Director is hereby authorized
and directed to pay the same forthwith.
The motion for the adoption of the foregoing Resolution was duly seconded by
Councilmember Crain and upon vote being taken thereon, the
following voted in favor thereof: Mayor Schneider, Councilmembers Crain, Sisk,
Vasiliou. and Zitur
The following voted against or abstained: none
Whereupon the Resolution was declared duly passed and adopted.
