The following members were present: Mayor SchneiderZ.ouncilmembers Crain, Sisk Vaslliou, and Zitur Me- 0 owing members were absent: none Councilmember Zitur introduced the following Resolution and moved Its adoption: RESOLUTION NO. 87-151 APPROVING AN AMENDMENT TO THE MIXED PLANNED UNIT DEVELOPMENT PLAN, PRELIMINARY PLAT; AND, SETTING CONDITIONS TO BE MET PRIOR TO AND RELATED TO FILING OF THE FINAL PLAT FOR CROW -PLYMOUTH LAND LIMITED PARTNERSHIP FOR PLYMOUTH BUSINESS CENTER 4TH ADDITION (86139) (MPUD 78-1) WHEREAS, Crow -Plymouth Land Limited Partnership has requested approval of an Amendment to the Mixed Planned Unit Development Plan, Preliminary Plat and Plan; and of the Final Plat for Plymouth Business Center 4th Addition, a commercial plat located south of County Road 9 and northeast of Annapolis Lane; and, WHEREAS, the Planning Commission has reviewed the Amendment at a duly called Public Hearing and recommends approval; and, WHEREAS, the City Council has approved the proposed Final Plat and Development Contract; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MIN- NESOTA, that it should and hereby does approve the Amendment to the Mixed Planned Unit Development Plan, Preliminary Plat and Plan for Crow -Plymouth Land Limited Partnership for Plymouth Business Center 4th Addition, subject to the following conditions which also apply to the filing of the Final Plat: 1. Compliance with the City Engineer's Memorandum. 2. Removal of all dead or dying trees from the property at the owner's expense. 3. No Building Permits shall be issued until a Contract has been awarded for sewer and water. 4. Provisions for a 20 ft. wide trail outlot along County Road 9 and a 30 ft. wide trail easement along I-494 per Comprehensive Park Plan, as verified by the Parks and Engineering Departments, with submittal of detailed plans as to construction of the trail per City standards. 5. Payment of park dedication Pees -in -lieu of dedication with appropriate credits in an amount determined according to verified acreage and paving costs and according to the Dedication Policy in effect at the time of issuance of Building Permit. 6. No Building Permits shall be issued until the Final Plat is filed and recorded with Hennepin County. 0 PLEASE SEE PAGE TWO Page two ' Resolution No. 87-151 7. Access shall be limited to internal public roads and prohibited from County Road 9. 8. Final Plat mylars shall refer to PUD No. 78-1. 9. The lot line shall be adjusted so that each lot at least meets the Ordinance minimum area standard. The motion for adoption of the foregoing Resolution was duly seconded by Councilmember Sisk , and upon vote being taken thereon, the following voted In favor thereof: a or neider Councilmembers Crain Sisk Vasiliou and Zitur The following voted against or abstained: none Whereupon the Resolution was declared duly passed dna adopted.
