Pursuant to due call and notice thereof, a _gggiflar meeting of the City
Council of the City of Plymouth, Minnesota was held on the 2nd day
of March 1987. The following members were present:
Mayor Schneider, Councilmembers Crain, Sisk, Vasi_liou, and Zitur
The following members were absent: none
Councilmember Sisk introduced the following Resolution and moved
its adoption:
RESOLUTION NO. 87- 140
AUTHORIZING THE VACATION OF
CERTAIN UTILITY AND DRAINAGE EASEMENTS
OUTLOT "A" - MONTGOMERY 2ND ADDITION
WHEREAS, a petition was received to vacate certain utility and drainage
easements in Outlot "A", Montgomery 2nd Addition by the City Council; and
WHEREAS, a notice of publication of said hearing was published and posted two
weeks prior to the meeting of March 2, 1987; and
WHEREAS, the Council did hold a public hearing on March 2, 1987 to inform any
and all interested parties relevant to the vacation of said utility and
drainage easements in Outlot A, Montgomery 2nd Addition; in accordance with
Minnesota Statutes 412.851 as amended; and
WHEREAS, it was determined by the City Council that said utility and drainage
easements are no longer needed for public purposes;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA that the following utility and drainage easements are
hereby vacated:
Description of Parcel:
Outlot A, Montgomery 2nd Addition, Hennepin County, Minnesota
according to the recorded plat thereof.
Description of Easement:
A permanent easement for utility and drainage purposes over, under,
across and through that part of the South 10 feet of the above
described parcel lying East of the West 10 feet, thereof, and West
of the Southeasterly 25 feet thereof is measured perpendicular to
the Southeasterly line of above described parcel.
The motion for the adoption of the foregoing Resolution was duly seconded by
Councilmember Zitur , and upon vote being taken thereon, the
following voted in favor thereof: Mayor Schneider. Councilmembers Crain, Sisk,
Vasiliou. and Zitur
The following voted against or abstained: none
Whereupon the Resolution was declared duly passed and adopted.
