The following members were present: Mayor Schneider�o nciimembers ra nSisk. Vasiliou and Zitur Whe following mem ers were absent: none Councilmember Vasiliou introduced the following_ Resolution and moved its adoption: RESOLUTION NO. 87-64 APPROVING APPEAL BY LOUIS COSENTINO OF BOARD OF ZONING ADJUSTMENTS AND APPEALS RULING AND GRANTING VARIANCE FOR A GARAGE ADDITION AT 2435 HOLLY LANE NORTH WHEREAS, Louis Cosentino, pursuant to Section 11, Subdivision C of the Plymouth Zonan;, Ordinance, has appealed the January 13, 1987 Ruling of the Board of Zoning Adjustments and Appeals, relative to his request for a Variance from the minimum building side yard setback at 2435 Holly Lane North, also described as Lot 4, Block 4, SunnyAcres Second Addition, Hennepin County, Minnesota; and, WHEREAS, the Board of Zoning Adjustments and Appeals considered the matter and the Ruling was made to Deny the Variance; and, WHEREAS, the City Council has reviewed the proceedings of the Board of Zoning Adjustments and Appeals, as well as the petitioner's application for the Variance; NOW, THEREFORE BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the Appeal by Louis Cosentino of the Board of Zoning Adjustments and Appeals Ruling and grants the necessary Variance for the 12 ft. garage addition and Its encroachment Into the required side yard setback, based on and subject to the following: 1. Ordinance Variance Criteria have been met. 2. The variance is for a 2 ft. encroachment into the required sldeyard setback. 3. The steep driveway combined with the lack of a level parking pad has created a safety hazard; is unique to this parcel of land; and, a cause of hardship to the applicant. The motion for adoption of the foregoing Resolution was duly seconded by Councilmember Sisk , and upon vote being taken thereon, the Tollow nq voted n favor thereof: ounc lmembers Crain Sisk Vasiliou and Zitur eo owng voted against or abstained: Ma or 3chnelder Whereupon the Resolution was declared duly passed and adopted.
