HomeMy WebLinkAboutCity Council Resolution 1987-063CITY OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota was held on the 2nd day of February , 1987. The following members were present: Mayor Schneider, Councilmembers Crain, Sisk, Vasiliou, and Zitur The follGwing members were absent: none Councilmember Crain introduced the following Resolution and moved its adoption: RESOLUTION NO. 87- 63 AUTHORIZING THE VACATION OF CERTAIN DRAINAGE AND UTILITY EASEMENTS LOT 1, BLOCK "A", PLYMOUTH ORCHARDS BLOCK 7, BEACON HEIGHTS FIRST ADDITION WHEREAS, a petition was received to vacate certain utility and drainage easements in Lot 1, Block "A", Plymouth Orchards, Block 7, Beacon Heights First Addition; and WHEREAS, a public hearing with respect to said vacation was scheduled for February 2, 1987 in accordance with Minnesota Statutes 412.851 as amended; and WHEREAS, a notice of publication of said hearing was published and posted two weeks prior to the meeting of February 2, 1987; and WHEREAS, the Council did hold a public hearing on February 2, 1987 to inform any and all interested parties relevant to the vacation of certain easements in Lot 1, Block "A", Plymouth Orchards, Block 7, Beacon Heights First Addition; and WHEREAS, it was determined by the City Council that said easements were not needed for public purposes; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA that the following utility and drainage easements be vacated: DESCRIPTION OF PARCEL: Tract A: Lot 1, Block A, Plymouth Orchards, together with that portion of 16th Avenue North accruing thereto by reason of the vacation thereof, according to the recorded plat thereof, and situate in Hennepin County, Minnesota. Abstract Property. Tract B: Par 1: That part of Block 7, Beacon Heights First Addition, according to the plat thereof on file or of record in the Office of the Register of Deeds in and for said County, lying Westerly of a line and its extensions drawn Southerly from a point on the North line of said Block 7 distant 68.00 feet East Resolution No. 87-63 Page Two of the Northwest corner of said Block 7 to a point on the Southeasterly line of said Block 7, distant 105.00 feet Northeasterly of the Southwesterly corner of said Block 7, according to the recorded plat thereof, and situate in Hennepin County, Minnesota. Par 2: That part of Block 7, Beacon Heights First Addition, lying within the circumference of a circle having a radius of 70.00 feet the center of said circle described as being a point 20.00 feet Northerly of the North line of the South 1/2 of the Southwest 1/4 of Section 26, Township 118, Range 22, on a line that is 62.00 feet Easterly of the Northeasterly extension of the West line of said South 1/2 of the Southwest 1/4, except that part lying Westerly of a line and its extensions drawn Southerly from a point on the North line of said Block 7 distant 68.00 feet. East of the Northwest corner of said Block 7 to a point on the Southeasterly line of said Block 7, distant 105.00 feet Northeasterly of the Southwesterly corner of said Block 7, together with that portion of 16th Avenue North accruing thereto by reason of the vacation thereof. According to the plat thereof on file or of record in the Office of the Register of Deeds in and for said County of Hennepin, State of Minnesota. Being registered land as is evidenced by Certificate of Title No. 676482. DESCRIPTION OF EASEMENT: The easement to be vacated lies 6.00 feet on either side of and begins 10.00 feet Southeasterly of and terminates 10.00 feet Northwesterly of the following described line: Commencing at the Northwest corner of Block 7, Beacon Heights First Addition, thence East 68.00 feet along the North line of said Block 7 to the point of beginning of the line to be described: Thence Southeasterly to a point on the Southeasterly line of said Block 7, distant 105.00 feet Northeasterly of the Southwesterly corner of said Block 7 and there terminating.
