HomeMy WebLinkAboutCity Council Resolution 1987-004CITY OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota, was held on the day of Januar , 1987. The following members were present: Mayor Schneider, Councilmembers Crain, Sisk, Vasiliou, and Zitur The following members were absent: none Councilmember Vasiliou introduced the following Resolution and moved its adoption: RESOLUTION NO. 87-04 APPROVING A CONDITIONAL USE PERMIT FOR C.O.M.B. COMPANY (86135) WHEREAS, C.O.M.B. Company has requested a Conditional Use Permit to allow the Instal- lation of a 6 ft. terrestrial microwave antenna and support tower on the roof of the facility at 1405 Xenium Lane North; and, WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MIN- NESOTA, that it should and hereby does approve the request by C.O.M.B. Company for a Conditional Use Permit to allow the installation of a 6 ft. terrestrial microwave antenna and support tower on the roof of the facility at 1405 Xenium Lane North, subject to the following conditions: 1. The permit is subject to all applicable codes, regulations and Ordinances, and violation thereof shall be grounds for revocation. 2. The permit is issued to the C.O.M.B. Company as operator of the facility and shall not be transferable. 3. The site shall be maintained in a sanitary manner. 4. There shall be no signage allowed on the antenna or tower relative to the use. 5. The permit shall be reviewed in one year to assure compliance with the conditions. 6. Compliance with applicable Building Code requirements shall be verified as part of the Building Permit issuance. 7. Maximum height of the total antenna and tower structure is 59 ft. from the around. 8. The equipment shall be removed when its functional use has ended. 9. The Council notes that there is a topographical depression in the land and the tower is the only way to achieve a straight line contact with the tower at the downtown Pillsbury Center. The motion for adoption of the foregoing Resolution was duly seconded by Councilmember Zitur , and upon vote being taken thereon, the o ow nq voted in favor thereof: Ma or Schneider, Councilmembers Crain Sisk Vasiliou and Zitur The Tollowing voted against or abstained: none ---Whereupon the Resolution was declared duly passed and adopted.
