HomeMy WebLinkAboutCity Council Resolution 1986-839CITY OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota was held on the 15th day of December , 1986. The following members were present: Mayor Schneider, Councilmembers Crain, Sisk, Vasiliou, and Zitur The following members were absent: none Councilmember Sisk introduced the following Resolution and moved its adoption: RESOLUTION NO. 86-839 AUTHORIZING CONDEMNATION PROCEEDINGS PROJECT NO. 655 SANITARY SEWER NORTH FROM 45TH TO NORTH LINE OF KINGSVIEW HEIGHTS 2ND ADDITION WHEREAS, the City of Plymouth has undertaken Project No. 655; and WHEREAS, in order to construct the improvements certain permanent and temporary easements are required; and WHEREAS, the City Council received a petition from Craig Scherber for the extension of Fernbrook Lane and extension of sanitary sewer lines to serve the future Kings North Plat North of Kingaview Heights 2nd Addition; and WHEREAS, the City Council, via Resolution No. 86-234, declared the adequacy of such petition from Craig Scherber; and WHEREAS, the City Council finds it necessary, proper and expedient in the interests of the public health, convenience and general welfare of the citizens of the City of Plymouth for the City to acquire said easements; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that the City Attorney is hereby authorized to commence condemnation proceedings for Project No. 655 for the following described easement within the following described parcel: Description of Parcel: (09-118-22-44-0038) Outlot J, Kingaview Heights 2nd Addition, Hennepin County, Minnesota according to the recorded plat thereof. Description of Easement: A permanent utility easement for sanitary sewer purposes over, under, across and through that part of the above described parcel described as follows: A strip of land 20 feet in width extending from 45th Avenue on the South through said Outlot J and extending to the North line of the Kingaview Heights 2nd Addition Plat; and Resolution No. 86-839 Page Two A temporary easement for construction purposes over, under, across and through that part of the above described parcel described as follows: A strip of land 60 feet in width extending from 45th Avenue on the South through Outlot J to the North line of the Ringsview Heights 2nd Addition Plat. The above described temporary easement shall terminate on December 31, 1987 or upon completion of construction, whichever occurs first. The motion for the adoption of the foregoing Resolution was duly seconded by Councilmember 71tur , and upon vote being taken thereon, the following voted in favor thereof: Mayor Schneider, Councilmembers "'rain. Sisk, Vasiliou, and Zitur The following voted against or abstained: none Whereupon the Resolution was declared duly passed and adopted.
