Pursuant to due call and notice thereof, a regular meeting of the City
Council of the City of Plymouth, Minnesota was held on the 15th day of
December , 1986. The following members were present:
Mayor Schneider, Councilmembers Crain, Sisk, Vasiliou, and Zitur
The following members were absent: none
Councilmember Zitur introduced the following Resolution and moved
its adoption:
RESOLUTION NO. 86-834
REQUEST FOR PAYMENT NO 3 AND FINAL
rERNBROOK LANE/T.H. 55 - INTERSECTION IMPROVEMENTS
PROJECT NO. 604
WHEREAS, the City of Plymouth as owner and Midwest Asphalt Corporation as
contractor have entered into an agreement for the Fernbrook Lane/T.H. 55
Intersection Improvements Project, City Project No. 604, said agreement being
dated July 29, 1986; and
WHEREAS, the engineer has certified his acceptance of the work and his approval
of the final request for payment:
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA:
10 1. That the original contract amount was $64,787.75 a change order of
$9,234.00 was approved and the value of the work to date is
$70,846.20.
2. That the work performed by the contractor for the Fernbrook
Lane/T.H. 55 Intersectior Improvements Project and certified to the
Council by the engiuncr as acceptable be and the same is hereby
released from the contract except as to the conditions of the
performance boi:d, any and all legal rights of the owner, required
guarantees and correction of faulty work after final payment.
3. Request for Payment No. 3 and Final in the amount of $11,708.51 to
Midwest Asphalt Company for Project No. 604 is hereby approved and
the City Finance Director is hereby authorized and directed to pay
the same forthwith.
The motion for the adoption of the foregoing Resolution was duly seconded by
Councilmember Sisk , and upon vote being taken thereon, the
following voted in favor thereof: Mayor Schneider, Councilmembers Crain,
Sisk, Vasiliou, and Zitur
The following voted against or abstained: none
Whereupon the Resolution was declared duly passed and adopted.
