Pursuant to due call and notice thereof, a reculararmeeting of the City Council of the
City of Plymouth, Minnesota, was held on the 1st day of December . 1986. The

Mayor Schneider introduced the following Resolution and moved its
adoption:
RESOLUTION NO. 86-794
APPROVING PRELIMINARY PLAT AND VARIANCE FOR RON CLARK, CLARK CONSTRUCTION COMPANY FOR
STONE HILL (86115)
WHEREAS, Ron Clark, Clark Construction Company, has requested approval for Rezoning,
Preliminary Plat and Variance for "Stone Hill" a plat for two lots on approximately
17.13 acres located east of I-494; west of Xenium Lane at 34th Avenue North: and,
WHEREAS, the Planning Commission has reviewed the request at a dilly called Public
Hearing, and recommends approval;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MIN-
NESOTA, that It should and hereby does approve Preliminary Plat and Variance for Ron
Clark, Clark Construction Company for two lots located east of I-494; west of Xenium
Elk Lane at 34th Avenue North, subject to the following conditions:
1. Compliance with the City Engineer's Memorandum
2. Removal of all dead or dying trees from the property at the owner's expense.
3. No Building Permits shall be issued until a Contract has been awarded for sewer
and water.
4. Payment of park dedication fees -in -lieu of dedication in accordance with the
Dedication Policy in effect at the time of issuance of Building Permit.
5. Compliance with Policy Resolution No. 79-80 regarding minimum floor elevations for
new structures in subdivisions adjacent to, or containing any open storm water
drainage facility.
6. Rezoning shall be finalized with filing of the Final Plat.
7. No Building Permits shall be issued until the Final Plat is filed and recorded
with Hennepin County.
8. No yard setback variances are granted or Implied.
9. Approved variances is the creation of proposed Lot 2, Block 1 which does not have
access to a pjblic road.

10. Proposed Lot 2, Block 1 shall be platted as an outlot on the Final Plat.
11. Appropriate legal documents for covenants and restrictions as approved by the City
Attorney, shall be filed with the Final Plat, specifically identifying the purpose
and use of proposed Lot 2, Block 1. The parcel shall be legally encumbered to
adjacent land unless legal standard public right-of-way and access is
granted and/or dedicated to and approved by the City.
12. The Final Plat application shall include a conceptual drawing demonstrating how
the two exception parcels could be incorporated into this development or could
develop on their own merits, given present guiding.
13. The Site Plan application shall include landscaping plans which provide buffering
and transition along Xenium Lane and for the single family development to the
east.
The motion for ado,:ion of the foregoing Resolution was duly seconded by
Councilmember Sisk , and upon vote being taken thereon, thefollow ng
