The following members were present: Mayor Schneider, =ouncilmembers train, lsk, VasTnou., and Zitur The following me ers were absent: none Councilmember Crain introduced the following Resolution and moved its adoption: RESOLUTION NO. 86-792 RESOLUTION POSTPONING ACTION ON CONDITIONAL USE PERMIT APPLICATION OF ALPHA HUMAN SERVICES, INC. FOR ADULT HALFWAY HOUSE (86080) WHEREAS, the Planning Commission has conducted public hearinqs on Auqust 27, 1986 and October 22, 1986 pertalninq to the Conditional Use Permit application of Alpha Human Services, Inc., to operate a state licensed adult halfway house in the City: and, WHEREAS, the ('ity Council has reviewed the Minutes of the Planning Commission meetings, the documents and other materials submitted to the Planning Commission, and other information provided to the City Council; and, WHEREAS, the City's Zoning Ordinance Is unclear as to the proper classification of such uses and the manner in which such uses should be regulated; and, WHEREAS, the Planning Commission has recommended that a study be conducted to determine how such uses should be regulated within the City; and, WHEREAS, the Planning Commission has recommended that a moratorium be established until such a study has been completed and any necessary amendments to the City's Zoninq Ordinance have been adopted; and, WHEREAS, the City Council has authorized a study to be conducted and has placed a moratorium and adopted an interim ordinance pursuant to Minnesota Statutes, Section 462.355, subd. 4 prohibiting approval of Conditional Use Permit applications, such as the one submitted by Alpha Human Services, Inc., during the moratorium period; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that action on the application of Alpha Human Services, Inc., for a Conditional Use Permit is postponed until one year from the effective date of Ordinance No. 86- 28 , or such earlier date as may be adopted by the City Council, provided that, if the study and planning process have not been completed within that one year period, the date may be extended for such additional period as deemed necessary by the City Council, not to exceed an additional period of eighteen months as permitted by State Statutes. The motion for adoption of the foregoing Resolution was duly seconded by Councilmember Zitur , and upon vote being waken thereon, the following voted in favor thereof: Mayor Schneider, Councilmembers Cain, Sisk, Vasiliou, and Zitur The o ow nq voted against or abstained: none Whereupon the Resolution was declared duly passed and adopted. •
