Pursuant to due call and notice thereof, a special meeting of the City
Council of the City of Plymouth, Minnesota was held on the 24th day
of November , 1986. The following members were present:
Mayor Schneider, Cnunrilmambars Crain, Sisk_ Vasilinu_ and 71tur
The following members were absent: none
Councilmember Sisk introduced the following Resolution and moved
its adoption:
RESOLUTION NO. 86-778
AUTHORIZING THE VACATION OF STREET RI(,"[ -OF -WAY
TEPLEY ADDITION
WHEREAS, a petition was received to vacate street right-of-way in the Tepley
Addition; and
WHEREAS, a public hearing with respect to said vacation was scheduled for
November 24, 1986 in accordance with Minnesota Statutes 412.851 as amended; and
WHEREAS, a notice of publication of said hearing was published and posted two
weeks prior to the meeting of November 24, 1986; and
WHEREAS, the Council did hold a public hearing on November 24, 1986 to inform
any and all interested parties relevant to the vacation of street right-of-vay
in the Tapley Addition; and
WHEREAS, it was determined by the City Council that said easement was not
needed for public purposes;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA that the following street right-of-way be vacated:
That portion of the following described easement lying within the Tepley
Addition:
The East 19.5 feet of the South one half (S 1/2) of the Northwest
one quarter (NW 1/4) of the Southeast one quarter (SE 1/4); and the
East 19.5 feet of the North one half (N 1/2) of the Southwest one
quarter (SW 1/4) of the Southeast one quarter (SE 1/4); and the
East 19.5 feet of the North 19.5 feet of the South one half (S 1/2)
of the Southwest one quarter (SW 1/4) of the Southeast one quarter
(SE 1/4) and the North 19.5 feet of the South one half (S 1/2) of
the Southeast one quarter (SE 1/4) of the Southeast one quarter (SE
1/4), all in Section 11, Township 118, Range 22.
That said vacation wall not affect the authority of any person, corporation or
municipality owning or controlling the electric or telephone poles and lines,
gas and sewer lines, or water pipes, mains and hydrants thereon or thereunder,
to continue maintaining the same, to enter upon such way or portion thereof
vacated to repair, replace, remove otherwise attend thereto.
The motion for the adoption of the foregoing Resolution was duly seconded by
Councilmember Crain , and upon vote being taken thereon, the
following voted in favor thereof: Mayor Schneider, Councilmembers Crain.
Sisk, Vasiliou, and Zitur
The following voted against or abstained: none
Whereupon the Resolution was declared duly passed and adopted.
