The following members were present: chneider, Councilmembers Crain, Vasiliou and Zitur owing members were absent: Councilmember Sisk *,k,k the City day of Councilmember Crain introduced the following Resolution and moved its adoption: RESOLUTION NO. 86-728 REQUEST FOR PAYMENT NO 8 AND FINAL CARLSON CENTER THIRD ADDITION PROJECT NO. 426 WHEREAS, the City of Plymouth as owner and Bury and Carlson, Inc. as contractor have entered into an agreement for the Carlson Center Third Addition, said agreement being dated June 25, 1985; and WHEREAS, the engineer has certified his acceptance of the work and his approval of the final request for payment: NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: 1. That the original contract amount was $353,818.07, one change order was approved for $8,738.84 and the value of the work completed to date is $371,376.93 and is herewith approved. 2. That the work performed by the contractor for the Carlson Center Third Addition and certified to the Council by the engineer as acceptable be and the same is hereby released from the contract except as to the conditions of the performance bond, any and all legal rights of the owner, required guarantees and correction of faulty work after final payment. 3. Request for Payment No. 8 and Final in the amount of $13,903.81 to Bury and Carlson, Inc. is hereby approved and the City Finance Director is hereby authorized and directed to pay the same forthwith. The motion for the adoption of the foregoing Resolution was duly seconded by Councilmember Zitur , and upon vote being taken thereon, the following voted in favor thereof: Mayor Schneider, Councilmembers Crain, Vasiliou, and Zitur The following voted againat or abstained: none Whereupon the Resolution was declared duly passed and adopted.
