introduced the following Resolution and moved its
adoption:
RESOLUTION NO. 36-716
RESOLUTION ORDERING THE ABATEMENT OF HAZARDOUS CONDI-
TIONS EXISTING AT 12510 28TH AVENUE NORTH IN THE CITY
OF PLYMOUTH.
WHEREAS, the Building Official of the City of Plymouth and
an official from the Hennepin County Community Health Department
have investigated the house located at 12510 28th Avenue North in
the City of Plymouth (the house, and all fixtures and other
personal property therein, as well as underlying land referred to
as "Property") and prepared a written report regarding hazardous
conditions which exist on the Property; and,
WHEREAS, based on said investigations and Report, the Build-
ing Official has recommended that proceedings be commenced for
the abatement of the hazardous conditions which exist on the
Property, all pursuant to and in accordance with Sections 463.15
et seq., Minnesota Statutes, or Sections 2010.01, Subds. 3-6,
Plymouth City Code; and,
WHEREAS, said report has been examined and considered by the
Council,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL AS
FOLLOWS:
1. That the conditions which presently exist on the Property,
as contained in the Report, Exhibit A attached hereto,
constitute a fire hazard or a hazard to public health and
safety due to inadequate maintenance, unsanitary conditions
and abandonment as defined in Section 463.15, Subd. 3,
Minnesota Statutes.
2. That the conditions which presently exist on the Property
constitute a public nuisance as defined by Section 2010.01,
Subd. 1(b), Plymouth City Code.
3. That the City Council hereby orders abatement of the hazard-
ous conditions which exist on the Property.
4. That the Mayor and City Manager be, and they hereby are,
authorized and directed to execute an Order, a copy of which
is attached hereto as Exhibit B, to be served upon the
required parties regarding the abatement of the hazardous
conditions on the Property, pursuant to Section 463.17,
Minnesota Statutes or Section 2010.01, Subd. 3, Plymouth
City Code.

5. That the property owner and all lienholders of record be
ordered and directed in writing to correct the conditions
set forth in the Report within thirty (30) days of service
of said Order as provided in Sections 463.17, Subd. 1 and
463.18, Subd. 2, Minnesota Statutes.
6. That if the hazardous condition is not .corrected within the
aforesaid thirty (30) days, the City is authorized to take
whatever action is necessary to obtain a judgment from a
court of competent jurisdiction allowing the City to abate
the hazardous conditions on the Property and to assess th,
cost of such abatement to the Property as provided by
Section 463.21, Minnesota Statutes or Section 2010.01, Subd.
5, Plymouth City Code; and to recover all administrative and
legal costs as provided by Section 463.22, Minnesota Stat-
utes or Section 2010.01, Subd. 4, Plymouth City Code.
