The following members were present: Mayor Schneider, ZTouncilmembers Crain, 91W, Vasrilou, and Zitur The following mem ers were absent: none Councilmember Vasiliou Introduced the following Resolution and moved its adoption: RESOLUTION NO. 86-697 APPROVING REVISED RESIDENTIAL PLANNED UNIT DEVELOPMENT PRELIMINARY PLAN/PLAT, AND CONDITIONAL USE PERMIT FOR JOHN KAROS FOR HERITAGE WEST 2ND ADDITION (RPUD 82-4) (86048) Whereas, John Karos has requested approval for a Revised Residential Planned Unit Development Concept Plan, Preliminary Plan/Plat, and Conditional Use Permit for Ileri- tage West 2nd Addition for 21 single family residential lots east of Xenium Lane and west of Vinewood Lane In the Southeast Quadrant of Section 15; and, WHEREAS, the Planning Commission has reviewed the request at a duly called Public Hear- ing and recommends approval; and, WHEREAS, the City Council reviewed the request and, under Resolution No. 86-314, directed certain design modifications; NOW, THEREFORE, BF IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MIN- NESOTA, that It should and hereby does approve the Revised Residential Planned Unit Development Preliminary Plan/Plat, and Conditional Use Permit for John Karos for Heri- tage West 2nd Addition located east of Xenium Lane and West of Vinewood Lane in the Southeast Quadrant of Section 15, subject to the following conditions: 1. Compliance with the City Engineer's Memorandum. 2. Removal of all dead or dying trees from the property at the owner's expense. 3. No Building Permits shall be issued until the final plat is filed and recorded with Hennepin County. 4. Payment of park dedication fees -in -lieu of dedication in accordance with the Dedi- cation Pollc� In effect at the time of filing the Final Plat. 5. Street names shall comply with the City Street Naming System. 6. Compliance with Policy Resolution No. 79-80 regarding minimum floor elevations for new structures in subdivisions adjacent to or containing any open storm water drainage facility. 7. Appropriate legel documents regarding Homeowner Association covenants and restrictions as approved by the City Attorney, shall be filed with the Final Plat and shall include the requirement that Outlot A be available for all residents in both phases of this development. Outlot A shall be owned and maintained by the Homeowner's Association and shall be available to all residents in both phases of this development. 9. No Building Permits shall be issued until a contract has been awarded for municipal sewer and water. 10. Yard setbacks are 35 ft. front yard; 10 ft. side yard; and 25 ft. rear yard for the single family detached units; a 50 ft. setback is required along Xenium Lane. 11. Staging of the development shall be in accordance with utility availability as approved by the City Engineer. 12. Maximum revised density is 1.93 units per acre for the land at, or above the established High Water Elevation per the adopted City Storm Water Drainage Plan as verified by the City Engineer. The maximum number of units shall be 57 single family detached dwellings. 13. A waiver from the 40 acre minimum size requirements for PUDs is contingent upon an executed Development Contract and is approved on the basis that the proposal is an extension of a development tl;at was approved under the PUD provisions. 14. No private drive access shall be permitted to Xenium Lane; all private drives shall be provided by internal public streets. 15. The final grading plan shall provide berming and landscaping along Xenium Lane to provide a transition between the dwelling units and the roadway ?,.id especially as affects Lot 1, Block 1, and Lot 6, Block 2. 16. Construction vehicle traffic associated with the public utility and street Improvements shall enter from Xenium Lane. 17. The Final Plan/Plat shall show the mature trees and shall specify what mitigation measures will be taken to preserve them.
