The following members were present: Mayor Schneider-7to—uncilmembersra n,_ s , VATIiou, and Zitur The following mem ers were absent: none Councilmember Zitur introduced the following Resolution and moved its adoption: RESOLUTION NO. 86-694 APPROVING SITE PLAN AND CONDITIONAL USE PERMIT FOR ASPHALT DRIVEWAY COMPANY (86102) WHEREAS, Asphalt Driveway Company has requested approval of a Site Plan and Conditional Use Permit to allow the conversion and use of a single family dwelling for offices and storage; for outside storage of trucks and trailers; and, to allow a three -pump dispensing area on property at 9905 10th Avenue North, in the I-1 (planned industrial) Zoning District; and, WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MIN- NESOTA, that it should and hereby does approve the request for Asphalt Driveway Company for a Site Pian and Conditional Use Permit for property in the I-1 (planned industrial) District at 9905 10th Avenue North, subject to the following conditions: 1. Compliance with City Engineer's Memorandum. 2. Payment of park dedication fees -in -lieu of dedication in accordance with the Dedication Policy in effect at the time of Building Permit issuance. 3. Submission of required financial guarantee and Site Performance Agreement for completion of site improvements. 4. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. 5. The permit is subject to all applicable codes, regulations and Ordinances, and violation thereof shall be grounds for revocation. 6. The permit is Issued to the Asphalt Driveway Company as operator of the facility and shall not be transferable. 7. The site shall be maintained in a sanitary manner. 8. All waste and waste containers shall he stored within approved designated areas as diagrammed on the plans dated September 20, 1986. 9. Any signage shall conform with the City Ordinance standards. There shall be no outside display, sales, or storage of merchandise or related materials, other than the storage of trucks and trailers in the 5 identified park- ing spaces. 11. The permit shall be renewed in one year to assure compliance with the conditions. 12. Conversion of the dwelling in compliance with applicable Building and Fire Code requirements shall be verified by the City prior to Conditional Use Permit issu- ance and building occupancy by any non-residential uses. No residential occupancy is allowed. 13. All parking shall be off-street in designated areas which comply with the Zoning Ordinance. 14. No signage, relative to the fuel dispensing area is permitted, other than required safety information and operating instructions. This includes signage by words, graphics, logos and symbols. 15. The design, construction, location and installation of the equipment must comply with State and City Codes including appropriate National Fire Protection Associa- tion specifications and Uniform Fire Code requirements. 16. Add one Black Hills Spruce to the south side of the driveway and two Black Hills • Spruce to the north side of the drive to Nathan Lane; minimum height is 6 ft. 17. All areas not otherwise improved as part of the site development shall be sodded. 18. All parking and drive areas, shall at a minimum be prepared with required gravel base, as approved by the City Engineer prior to issuance of the permit and build- ing occupancy. The parking and drives shall be paved, per required standards and in accordance with approved plans, no later than May 31, 1987. The motion for adoption of the foregoing Resolution was duly seconded by Councilmember Sisk , and upon vote being taken thereon, the o ow ng vote n favor thereof: neider, Councilmembers Crain Sisk, Vasiliou and Zitur The following voted against or abstained: none hereupon the Resolution was declared duly passed and adopte
