HomeMy WebLinkAboutCity Council Resolution 1986-693CITY Or FUNDUM Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota, was held on the 20th day of October, 1986. The following mewhers were present: Mayor Schneide—Z o etimembers ra n Sisk: Vas itou and Zitur e following rs were absent: none Councilmember Zitur introduced the following Resolution and moved its adoption: RESOLUTION NO. 86-693 SETTING CONDITIONS TO BE MET PRIOR TO FILING AND REGARDING LOT DIVISION FOR JOHN O'DONNELL (86097) WHEREAS, the City Council has approved a Lot Division and Variance from the Urban Development Policy for John O'Donnell for property located east of 5535 Dunkirk Lane, under Resolution No. 86-692; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MIN- NESOTA, that it should and hereby does direct the following conditions to be met prior to filing of and regarding said Lot Division: 1. Compliance with the City Engineer's Memorandum. 2. No yard setback variances are granted or implied. 3. Compliance with Policy Resolution No. 79-80 regarding minimum floor elevations for new structures on sites adjacent to, or containing open storm water drainage . facilities. 4. Payment of park dedication fees -in -lieu of dedication prior to filing of the Division in accordance with City Policy in effect at the time of filing of the Division. 5. No Building Permit to be issued until the Lot Division Is filed with Hennepin County. 6. Submittal of all necessary utility easements prior to filing Lot Division with Hennepin County. 7. Appropriate deed restrictions and covenants, as approved by the City Attorney, shall be filed on the property restricting future division of the property, until urban utilities are available and in accordance with City Codes and Ordinances. 8. Approved Variance from the Urban Development Policy No. 75-664 and Subdivision Code on the basis that the Variance Criteria are satisfied and the proposal is consistent with the intent of legal standards for rural lot divisions, given the factional deficiency of one parcel. The motion for adoption of the foregoing Resolution was duly seconded by Councilmember Sisk , and upon vote being taken thereon, the o ow nq voted In favor thereof: a orneider, Councilmembers Crain Sisk, Vasilloug and Zitur The TolLowIng . voted against or abstained: none hereupon the Resolution was declared duly passed and adopted.
