Pursuant to due call and notice thereof, a regular meeting of the City
Council of the City of Plymouth, Minnesota was held on the 6th day of
Ortnhpr , 1986. The following members were present:
10 Mayor Srhnpider, CnunrilmpmhprS Crain. Vasilinu, and Zitur
The following members were absent: Councilmember Sisk
Councilmember Crain introduced the following Resolution and moved its
adoption:
RESOLUTION NO. 86- 689
ROBERT MIDDLEMIST ADDITION CONSTRUCTION OF STORM SEWER ON
COUNTY ROAD 9
WHEREAS, the City of Plymouth and Robert Middlemist have entered into a
Development Contract dated April 30, 1984; and
WHEREAS, Mr. Middlemist obligated himself to construct and complete certain
subdivision improvements pursuant to the terms of the Development Contract,
including a storm sewer along the South side of County Road 9; and
WHEREAS, Mr. Middlemist obligated himself to these improvements and has provided
the City of Plymouth with a Letter of Credit in the amount of $12,000 and agrees
to install said storm sewer as per the plans and specifications approved by the
City of Plymouth, Engineering Department.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
. MINNESOTA: That the City Manager is authorized to enter into an agreement with
Mr. Robert E. Middlemist, Jr. for the construction of storm sewer along the South
side of County Road 9 which is to be paid for entirely by Mr. Middlemist per the
agreement between Robert E. Middlemist, Jr. and the City of Plymouth dated
September 30, 1986.
The moti-n for the adoption of the foregoing Resolution was duly seconded by
Council -amber Zitur , and upon vote being taken thereon, the following
voted in favor thereof: Mayor Schneider, Councilmembers Crain
. Vasiliou. and Zitur
The following voted against or abstained: none
Whereupon the Resolution was declared duly passed and adopted.
