Pursuant to due call and notice thereof, a regular meeting of the City
Council of the City of Plymouth, Minnesota was held on the 6th day of
October , 1986. Mae following members were present:
Mayor Schneider, Councilmembers Crain, Vasiliou. and Zitur
The following members were absent: Councilmember Sisk
Councilmember Zitur introduced the following Resolution and moved
its adoption:
RESOLUTION NO. 86-682
REQUEST FOR PAYMENT NO. 5 AND FINAL
SWAN LAKE ADDITION - STREET AND UTILITY IMPROVEMENTS
PROJECT 539
WHEREAS, the City of Plymouth as owner and Latour Construction Company, as
contractor have entered into an agreement for the Swan Lake Addition Street and
Utility Improvement Project, City Project No. 539, said agreement being dated
October 15, 1985; and
WHEREAS, the engineer has certified his acceptance of the work and his approval
of the final request for payment:
NOW, THEREFORE, BE IT HEREBY RESOLVED uY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA:
1. That the original contract amount was $333,667.35 a change order of
$10,800.00 was approved and the value of the work to date is
$345,899.71.
2. That the work performed by the contractor for the Swan Lake
Addition Street and Utility Improvement Project and certified to
the Council by the engineer as acceptable be and the same is hereby
released from the contract except as to the conditions of the
performance bond, any and all legal rights of the uwner, required
guarantees and correction of faulty work after final payment.
3. Request for Payment No. 5 and Final in the amount of $22,648.35 to
Latour Construction Company for the Swan Lake Addition Street and
Utility Improvement Project is hereby approved and the City Finance
Director is hereby authorized and directed to pay the same
forthwith.
The motion for the adoption of the foregoing Resolution was duly seconded by
Councilmember Vasiliou , and upon vote being taken thereon, the
following voted in favor thereof: Mayor Schneider, Councilmembers Crain,
Vasiliou, and Zitur
The following voted against or abstained: none
Whereupon the Resolution was declared duly passed and adopted.
