The following members were present: Mayor Schneider, Co cilmembers— afn, '!as lion; end Zitur iThe' following members were absent: Councilmember Sisk Councilmember Crain introduced the following Resolution and moved its adoption: RESOLUTION NO. 86-658 DENYING APPEAL BY RAYMOND MOLES OF BOARD OF ZONING ADJUSTMENTS AND APPEALS RULING WHEREAS, Raymond Moles, pursuant to Section 11, Subdivision C., of the Plymouth Zoninq Ordinance, has appealed the September 16, 1986 ruling of the Board of Zoning Adjust- ments and Appeals, relative to his request for an appeal from an administrative order at 11200 46th Avenue North, also described as Lot 7, Block 1, DEERWOOD ESTATES PLAT T_II, Hennepin County, Minnesota; and, WHEREAS, the petitioner appealed an administrative order to remove/relocate a 6 -ft. fence in the required front yard which is in violation of the Zoning Ordinance; and, WHEREAS, the Board of Zoning Adjustments and Appeals considered the matter on September 16, 1986, at which time the ruling was made to deny the appeal; and, WHEREAS, the City Council has reviewed the proceedings of the Board of Zoning Adjust- ments and Appeals, as well as the petitioner's application for the appeal; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MIN- NESOTA, that it should and hereby does deny the appeal by Raymond Moles from the Board of Zoning Adjustments and Appeals ruling for the following reasons: 1. Granting of the appeal would establish an undesirable precedent for corner lots in the City of Plymouth. 2. Standards for a Variance have not been met. 3. The Ordinance violation resulted from an action by the appellant and should be corrected, per the administrative order. The motion for adoption of the foregoing Resolution was duly seconded by Councilmember Zitur , and upon vote being taken thereon, the o ow Mna voted in favor thereof: Mayor Schneider, Councilmembers Crain, Vasillou, and Zitur eo ow ng voted against or abstained: none hereupon the Resolution was declared duly passed and adopted.
