RESOLUTION NO. 86-657
DENYING APPEAL BY RICHARD T. MICHELIZZI OF BOARD OF ZONING ADJUSTMENTS AND APPEALS
RULING
WHEREAS, Richard T. Michelizzi, pursuant to Section 11, Subdivision C., of the Plymouth
Zoning Ordinance, has appealed the August 12, 1986 ruling of the Board of Zoning
Adjustments and Appeals, relative to his request for a variance at 9735 29th Avenue
North, also described as Lot 10, Block 2, DEVRIES 2ND ADDITION, Hennepin County,
Minnesota; and,
WHEREAS, the petitioner has requested a 6.5 ft. variance from the Ordinance minimum
10 requirement of 15 ft. for the addition of a deck to his residence; and,
WHEREAS, the Board of Zoning Adjustments and Appeals considered the matter on August
12, 1986, at which time the ruling was made to deny the Variance request as submitted;
and,
WHEREAS, the City Council has reviewed the proceedings of the Board of Zoning
Adjustments and Appeals, as well as the petitioner's application for the Variance and
for the Appeal;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA, that it should and hereby does deny the Appeal by Richard T. Michelizzi from
the Board of Zoning Adjustments and Appeals ruling for the following reasons:
1. The Variance Criteria have not been met.
2. This would establish an undesirable precedent in the City.
The motion for adoption of the foregoing Resolution was duly seconded by
Councilmember Zitur , and upon vote being taken thereon, the follow ng
voted in favor thereof: Mayor Schneider, Councilmembers Crain Vasiliou and Zitur
The following
voted against or abstained: none hereupon the
Resolution was declared duly passed and adopted.
