HomeMy WebLinkAboutCity Council Resolution 1986-632CITY OF PLYMOUTH Pursuant to due call and notice thereof, a special meeting of the City Council of the City of Plymouth, Minnesota was held on the 29th day of Sp tt"n_pmhpr , 1986. The following members were present: Mavnr Schnpidpr- CQunrilmemh rc Crain, Sisk. Vasiliou_ and Zitur The following members were absent: none Mayor Schneider introduced the following Resolution and moved its adoption: RESOLUTION NO. 86-632 REQUEST FOR PAYMENT NO 7 AND FINAL SCHMIDT GARDENS - UTILITY AND STREET IMPROVEMENTS PROJECT NO. 427 WHEREAS, the City of Plymouth as owner and Burachville Construction, Inc., as contractor have entered into an agreement for the Schmidt Gardens Utility and Street Improvement Project, City Project No. 427, said agreement being dated July 1, 1985; and WHEREAS, 'he engineer has certified his acceptance of the work and his approval of the final request for payment: NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: 1. That the original contract amount was $241,069.77, two (2) change orders were approved in the amount of $1),957.33 and the value of the work to date is $297,000.20. 2. That the work performed by the contractor for the Schmidt Gardens Utility and Street Improvement Project is certified to the Council by the engineer as acceptable be and the same is hereby released from the contract except as to the conditions of the perforsiance bond, any and all legal rights of the owner, required guarantees and correction of faulty work after final payment. 3. Request for Payment No. 7 and Final in the amount of $24,495.02 to Burachville Construction, Inc. for the Schmidt Gardens Improvement Project is hereby approved and the City Finance Director is hereby authorised and directed to pay the same forthwith. The motion for the adoption of the foregoing Resolution was duly seconded by Councilmember Zitur , and upon vote being taken thereon, the following voted in favor thereof: Mayor Schneider, Couneilmeabers Crain. Sisk. Vasiliou. and Zitur The following voted against or abstained: none Whereupon the Resolution was declared duly passed and adopted.
