Pursuant to due call and notice thereof, a special meeting of the City Council of the City of Plymouth, Minnesota, was held on the 29th day of Se tember . 1986. The following members were present: Mayor Schneider, Z—ouncilmembers ra n, s , Va–sTliou, and Zitur The following mem ers were absent: none Councilmember Zitur introduced the following Resolution and moved Its adoption: RESOLUTION NO. 86-601 APPROVING PRELIMINARY PLAT AND CONDITIONAL USE PERMIT FOR CLARENCE LAPOINTE FOR FRENCHIE LAPOINTE'S ADDITION (86094) WHEREAS, Clarence LaPointe has requested approval for a Rezoning, Preliminary Plat and Conditional Use Permit for Frenchie Lapointe's Addition for three residential lots at 435 Zinnia Lane; and, WHEREAS, the Planning Commission has reviewed the request at a duly called Public Hear- ing and recommends approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MIN- NESOTA, that it should and hereby does approve the Preliminary Plat and Conditional Use Permit for Clarence LaPointe for Frenchie LaPofnte's Addition located at 435 Zinnia g1k Lane, subject to the following conditions: 1. Compliance with the City Engineer's Memorandum. 2. Removal of all dead or dying trees from the property at the owner's expense. 3. No Building Permits shall be issued until a Contract has been awarded for sewer and water. 4. Payment of park dedication fees -in -lieu of dedication in accordance with the Dedication Policy in effect at the time of filing the Final Plat. 5. Rezoning shall be finalized with filing of the Final Plat. 6. No Building Permits shall be issued until the Final Plat is filed and recorded with Hennepin County. 7. No yard setback variances are granted or implied and shall comply with the R-2 District standards for a single-family detached dwelling. 8. The Conditional Use Permit is for development of single-family detached dwellings per the petitioner's request.
