HomeMy WebLinkAboutCity Council Resolution 1986-488CITY OF PLYMOUTH Pursuant to due call and notice thereof, a regular_ meeting of the City Council of the City of Plymouth, Minnesota, was held on the18th- day of August . 1986. The following members were present: Mayor Schneider—,-- Crain, Sisk, VasTliou, and Zitur The following mem ers were absent: none Councilmember Vasiliou introduced the following Resolution and moved its adoption: RESOLUTION NO. 86-488 APPROVING PRELIMINARY PLAT AND VARIANCES FOR ROBERT MIDDLEMIST FOR TEPLEY ADDITION (86078) WHEREAS, Robert Middlemist has requested approval for Rezoning, Preliminary Plat and Variances for "Tepley Addition" a plat for ten single family residential lots west of Zachary Lane and east of Zachary Lane Park, north of the City water tower; and, WHEREAS, the Planning Commission has reviewed the request at a duly called Public Hear- ing and recommends approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MIN- NESOTA, that it should and hereby does approve the Preliminary Plat and Variances for "Tepley Addition" west of Zachary Lane and east of Zachary Lane Park, north of the City . water tower, subject to the following conditions: 1. Compliance with the City Engineer's Memorandum. 2. The Ordinance rezoning the property shall be published upon evidence that the Final Plat has been filed and recorded with Hennepin County. 3. Provisions for a 30 -ft. wide trail outlot between Lots 3 and 4 per Comprehensive Park Plan, as verified by the Parks and Engineering Departments, with submittal of detailed plans as to construction of the trail per City standards. The trail out - lot shall be dedicated to the City, as part of the final platting. 4. Payment of park dedicaton fees -in -lieu of dedication with appropriate credits in an amount determined according to verified acreage and paving costs and according to the Dedication Policy in effect at the time of filing the Final Plat. The trail shall be paved as part of this development, per the City Park Dedication Policy. 5. No Building Permits shall be issued until a Contract has been awarded for the con- struction of municipal sewer and water. 6. Removal of all dead or dying trees from the property at the owner's expense. 7. A variance is approved to allow a 25 ft. minimum front yard setback for proposed Lot 4, noting the depth of the lot and its location between the park and the proposed street. No other yard setback variances are granted or implied. PLEASE SEE PAGE TWO Page two Resolution No. 86-488 8. Approved Variances are length of Arrowood Lane (1100 ft. vs. 500 ft.) and lot depth minimum of 75 ft. vs. 120 ft. for Lots 4 and 5. 9. Submittal of required utility and drainage easements as approved by the City Engineer prior to filing the Final Plat. 10. No Building Permits to be issued until the Final Plat is filed and recorded with Hennepin County. 11. Lots 6 and 7 shall be final platted as an outlot. 12. Access shall be limited to internal public roads and restricted from Zachary Lane: except that driveway access from proposed Lot 6 (part of the outlot) which shall be maintained until further platting occurs. 13. Appropriate legal documents, as approved by the City Attorney, shall be recorded on the outlot consisting of proposed Lot 6 and Lot 7, indicating that in conjunction with this plat, conceptual documents have been placed on Me with the City, also to require that with further platting of the outlot, the existing driveway shall be removed and re -directed to Arrowood Lane. 14. Construction access shall be provided across Lot 9 to Zachary Lane for all construction equipment until the first house is certified for occupancy, this is to include blocking Arrowood Lane with a fence.
