Pursuant to due call and notice thereof, a regular meeting of the City
Council of the City of Plymouth, Minnesota was held on the, day
of August 1 1986. The following members were present: Mayor Schneider,
ouncilmemoers Sisk, Vasiliou, and Zitur
The following members were absent: CnuncilmPmhPr Crain
Councilmember Vasiliou introduced the following Resolution and moved
its adoption:
RESOLUTION NO. 86-448
AUTHORIZING THE VACATION OF CERTAIN STREETS AMD UTILITY EASEMENTS IN
PLYMOUTH GARDENS ADDITION
WHEREAS, a petition was received to vacate certain utility and drainage
easements and streets in the Plymouth Gardens Addition; and
WHEREAS, a public hearing with respect to said vacations was scheduled for
August 4, 1986 in accordance with Minnesota Statutes 412.851 as amended; and
WHEREAS, a notice of publication of said hearing was published and posted two
weeks prior to the meeting of August 4, 1986; and
WHEREAS, the Council did hold a public hearing on August 4, 1986 to inform any
and all interested parties relevant to the vacation of the utility and drainage
easements and streets in the Plymouth Gardens Addition; and
Mtl6REAS, it was determined by the City Council that said easements and streets
were not needed for public purposeb;
' NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA that the following drainage and utility easements and
streets are hereby vacated:
That part of 9th Avenue (Huron Avenue), PLYMOUTH GARDENS, according to
the plat on file and of record in the office of the County Recorder,
Hennepin County, Minnesota, lying East of the Southerly projection of
the West line of Lot 15 of said PLYMOUTH GARDENS, and which also lies
West of the Southerly projection of the East line of Lot 20 of said
PLYMOUTH GARDENS.
That part of 8th Avenue (Yale Avenue), PLYMOUTH GARDENS, according to
the plat on file and of record in the office of the County Recorder,
Hennepin County, Minnesota, lying East of the Southerly projection of
the West line of Lot 14 of said PLYMOUTH GARDENS, and which also lies
West of the Southerly projection of the East line of Lot 9 of said
PLYMOUTH GARDENS.
That part of Nathan Lane (Erie Avenue), PLYMOUTH GARDENS, according to
the plat on file and of record in the office of the County Recorder,
Hennepin County, Minnesota, lying South of the Westerly projection of
the North line of Lot 15 of said PLYMOUTH GARDENS.

• A permanent easement for utility purposes over, under, across and
through the North 30 feet of that part of the Northeast Quarter of the
Southeast Quarter of Section 36, Township 118, Range 22, lying
Northwesterly of the Northwesterly right-of-way line of State Highway
No. 55, Hennepin County, Minnesota.
That part of the following described parcel: All that part of the
Northeast Quarter of the Southeast Quarter, Section 36, Township 118
North of Range 22 West lying SNorth of the centerline of County Road
No. 6 (6th Avenue North) except the North 10 rods thereof and except
the East 724 feet thereof.
Lying within a 60 foot strip o` land the centerline of which is
described as follows: Commencing at the Northwest corner of said
Northeast Quarter of the Southeast Quarter; thence Southerly along the
West line of said Northeast Quarter of the Southeast Quarter a distance
of 165 feet to the point of beginning of the line to be described,
thence Southerly along the West line of said Northeast Quarter of the
Southeast Quarter a distance of 40.4 feet; thence deflecting to the
right 53 degrees, 42 minutes, 30 seconds for a distance of 195.92 feet,
thence deflecting to the left 71 degrees, 32 minutes to the point of
intersection with the Northerly right-of-way line of State Highway 55
ek (Old 6th Avenue North).
This easement is for watermain purposes.
The Westerly 30 feet of the North 10 rods of the Northeast Quarter of
the Southeast Quarter of Section 36, Township 118 North of Range 22
West.
This easement is for watermain purposes.
The motion for the adoption of the foregoing Resolution was duly seconded by
Councilmember Zitur , and upon vote being taken thereon, the
following voted in favor thereof: _ Mayor Schneider, Councilmemb rs Sisk.
Vasiliou, and Zitur
The following voted against or abstained: none
Whereupon the Resolution was declared duly passed and adopted.
