Pursuant to due call and notice thereof, a regular meeting of the City
Council of the City of Plymouth, Minnesota was held on the 21St day
of July , 1986. The following members were presen-77-Nayor Schneider,
unc me ers rain, Sisk, Vasiliou, and Zitur
The following members were absent: Done
Councilmember Crain introduced the following Resolution and moved
its adoption:
RESOLUTION NO. 86--413
AUTHORIZING THE VACATION OF DRAINAGE AND UTILITY EASEMENTS IN
LAKE PARR HEIGHTS ADDITION
WHEREAS, a petition was received to vacate certain drainage and utility
easements in the plat of Lake Park Heights Addition; and
WHEREAS, a public hearing with respect to said vacation was scheduled for July
21, 1986 in accordance with Minnesota Statutes 412.851 as amended; and
WHEREAS, a notice of publication of said hearing was published and posted two
weeks prior to the meeting of July 21, 1986; and
WHEREAS, the Council did hold a public hearing on July 21, 1986 to inform any
and all interested parties relevant to the vacation of said easements; and
WHEREAS, it was determined by the City Council that said easements were not
needed for public purposes;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA that the following drainage and utility easements be
vacated:
Description of Parcel:
That part of the South 200 feet of the South 15 acres of the North
20 acres of Government Lot 2, in Section 24, Township 118, Range 22,
to -wit: beginning at the Southeast corner of the North 20 acres of
said Government Lot 2, Section 24, Township 118, Range 22, thence
West a distance of 943.8 feet to a point, thence North and parallel
to the East line of said Government Lot 2, a distance of 200 feet;
thence East 943.6 feet more less to the East line of said Government
Lot 2; thence South along the East line of said Government Lot 2 to
the point of beginning.
Description of Easements:
A permanent easement for street and utility purposes over, under,
across and through a strip of land 60 feet wide, 30 feet on either
side of that portion of the below described line which is contained
within the above parcel: Commencing at a point on the West line of
the Stensrud Addition 30 feet North to the Northwest corner of Lot
1, Block 2, Stensrud Addition, thence westerly along the extension
of the center line of 31st Avenue for a distance of 109.96 feet to a
point of curvature, thence deflecting to the Southwest along a
tangential curve having a radius of 100 feet and a central angle of
90 degrees 01' and 28" to the point of tangency, thence southerly
parallel to the West line of Stensrud Addition to the North line of
Timber Creek Addition and there terminating.
The motion for the adoption of the foregoing Resolution was duly seconded by
Councilmember Zitur , and upon vote being taken thereon, the
following voted in favor thereof: Mayor Schneider, Councilmembers Crain,
Sisk, VaS M OU. and Zitur
The following voted against or abstained: none
Whereupon the Resolution was declared duly passed and adopted.
