NOV Pursuant to due call and notice thereof, a Regular meeting of the City Council of
the City of Plymouth, Minnesota, was held on the Zn d day of June 1986.
The following members were present: Mayor Sc t—ne'Nicer, Councilmen ers rain, —
Sisk, Vasiliou and Zitur The
following members were absent: none
Mayor Schneider introduced the following Resolution and moved its
adoption:
RESOLUTION 86- 314
APPROVING REVISED RESIDENTIAL PLANNED UNIT DEVELOPMENT CONCEPT PLAN FOR JOHN KAROS FOR
HERITAGE WEST 2ND ADDITION (86048) (RPUD 82-4)
WHEREAS, John Karos has requested approval for a Revised Residential Planned Unit
Development Concept Plan for Heritage West 2nd Addition for single family residential
lots east of Xenium Lane and west of Vinewood Lane in the Southeast Quadrant of Section
15; and,
WHEREAS, the Planning Commission has reviewed the request at a duly called Public Hear-
ing and recommends approval;
.NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MIN-
NESOTA, that it should and hereby does approve the Revised Residential Planned Unit
Development Concept Plan for John Karos for Heritage West 2nd Addition located east of
Xenium Lane and West of Vinewood Lane in the Southeast Quadrant of Section 15, subject
to the following conditions:
1. Compliance with the City Engineer's Memorandum.
2. Removal of all dead or dying trees from the property at the owner's expense.
3. Compliance with Policy Resolution No. 79-80 regarding minimum floor elevations for
new structures in subdivisions adjacent to or containing any open storm water
drainage facility.
4. Appropriate legal documents regarding Homeowner Association covenants and
restrictions as approved by the City Attorney, shall be filed with the Final
Plat.
5. Outlot A shall be owned and maintained by the Homeowner's Association.
6. Staging of the development shall be in accordance with utility availability as
approved by the City Engineer.
7. Maximum density shall be based on the land at, or above the established High Water
Elevation per the adopted City Storm Water Drainage Plan as verified by the City
Engineer.

8. A waiver from the 40 acre minimum size requirements for PUDs is contingent upon an
executed Development Contract and is approved on the basis that the proposal is an
extension of a development that was approved under the PUD provisions.
9. No prtvate drive access shall be permitted to Xenium Lane; all private drives
shall be provided b• internal public streets.
10. The private open area behind Lots 2 and 3, Block 1, shall be eliminated.
11. The trees south and east of 38th Avenue shall be preserved which would in likeli-
hood eliminate two or more lots and would allow for approximately six acres of
open area.
12. Substantial berminq and landscaping to be provided along Xenium Lane for
transition from the land which is guided LA -4.
