Councilmember Vasiliou introduced the following Resolution and moved its
adoption:
RESOLUTION NO. 86-289
APPROVING PRELIMINARY PLAT AND VARIANCE FOR JAMES C. PETERSON & ASSOCIATES FOR
WILLOWWOOD NORTH (86033)
WHEREAS, James C. Peterson & Associates have requested approval for a Preliminary
Plat, Rezoning, and Variance for Willowwood North, a plat for eight single family lots
on approximately 4.11 acres east of Vicksburg Lane at 48th and 49th Avenues North (4830
Vicksburg Lane); and,
WHEREAS, the Planning Commission has reviewed the request at a duly called Public Hear-
ing and recommends approval;
- NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MIN-
NESOTA, that it should and hereby does approve the Preliminary Plat am Variance for
James C. Peterson & Associates for Willowwood North located east of Vicksburg Lane at
48th and 49th Avenues North, subject to the following conditions:
1. Compliance with the City Engineer's Memorandum.
2. Removal of all dead or dying trees from the property at the owner's expense.
3. No Building Permits shall be issued until a Contract has been awarded for sewer
and water.
4. Payment of park dedication fees -in -lieu of dedication in accordance with the
Dedication Policy in effect at the time of filing the Final Plat.
S. Street names shall comply with the City Street Naming System.
6. Compliance with Policy Resolution No. 79-80 regarding minimum floor elevations for
new structures in subdivisions adjacent to, or containing any open storm water
drainage facility.
7. Rezoning shall be finalized with filing of the Final Plat.
8. No Building Permits shall be issued until the Final Plat is filed and recorded
with Hennepin County.

9. No yard setback variances are granted or implied, and shall be 35 ft. to internal
public roads; 50 ft. to Vicksburg Lane; 25 ft. rear yard and 15 ft. side yard.
10. The approved variance is for lot width for Lot 1 of 77 ft., on the basis that it
Is consistent with the area.
11. Access shall be limited to internal public roads and there shall be none from
Vicksburg Lane.
12. Transitional screening and berming shall be provided along Vicksburg Lane.
13. Appropriate title documents shall be reviewed by the City Attorney prior to this
request being considered by the City Council.
14. The removal of the barn, garage and shed which are north and east of the residence
are to be removed at the developers expense, as part of the initial development.
15. The developer and the owner of the property shall enter into an agreement to be
recorded with the County Recorder, acknowledging that the existing residence on
Lot 8 is non -conforming and that the City Council, in approving the plat, is not
intending to render the residence conforming. The developer and owner also
acknowledge that Vicksburg Lane will ultimately be widened to urban standards
within the.existing right-of-way. Such upgrading could potentially result in the
• road pavement being located within 8 ft. of the residence located on Lot 8. The
Agreement shall be executed and recorded in conjunction with the Final Plat.
The motion for adoption of the foregoing Resolution was duly seconded by
Councilmember Crain . and upon vote being taken thereon, the following
voted in favor thereof: mayor c neider, Councilmembers Crain, Sisk,

voted against or abstained: none Whereupon the
Resolution was declared duly passed and adopted.
