Cnunc i 1 mOfalfier'C CI"d lii., sieg The oilowing members were absent: none �f COminC1.lmembe r Siiir introduced the following Resolution and moved its adoption: RESOLUTION No. 86- 275 RESOLUTION AMENDING PARK DEDICATION POLICY WHEREAS, the City Council has adopted amendments to the Zoning Ordinance regarding the calculation of maximum building coverage in the commercial and industrial districts; and, WHEREAS, reference to that Zoning Ordinance language should be established in the Park Dedication Policy most recentl; adopted as Resolution No. 86-89; NOW, THEREFORE BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the following amendment to the Park Dedication Policy: 4. Subdividers and developers of commercial and industrial land, including commer- cial and industrial portions of Mixed Planned Unit Developments (MPUD's), shall be required at the time the Site Plan is approved, and Building Permits are issued, to dedici*e to the City for park, playground, and public open space pur- poses, that amount of la:,d equal to 10% of the land area within the development upon which the maximum builoing coverage was calculated in accordance with the Zoning Ordinance. In those cases where the City shall require payment of fees in -lieu of such land dedication, the fees shall be in an amount equal to 10% of the Assessor's estimated undeveloped land value for such property zoned in the classification requested by the developer; the land used for this calculation shall be that upon which the ,maximum building coverage was calculated in accord- ance with the Zoning Ordinance. These values shall be determined based upon the City Assessor's estimate of the average value of undeveloped commercial and industrial land in the City. The City Manager shall provide the Council, at its first meeting in February, each year, or such other times as the Council may direct, with a report from the City Assessor indicating his estimate of the average value of undeveloped commercial and industrial land in the community and a survey of industrial/commercial fees in effect in comparable communities. In any event, the park dedication fees required shall not exceed $2,700.00 per acre. If the City determines that a developer shall be required to dedicate a portion of the land proposed for development for park or public open space pur- poses and such dedication does not satisfy the requirements of this policy, the balance due the City in cash shall be based upon the Assessor's estimated value of the undeveloped land proposed for development. The City may permit easements to be dedicated by developers for trail corridors identified in the City's Trail PLEASE SEE PAGE TWO Page two Resolution No. 86- 275 Corridor Plan thereby allowing the developer to include the land area in the determination of setbacks and building density on the site. In such cases, park dedication credit will not be given. FURTHER, Resolution No. 86-89 is hereby superseded. The motic,i for adoption of the foregoing Resolution was duly seconded by Councilmember Zitur , and upon vote being taken thereon, the fullowing voted in favor thereof: mayor Thneider, Councilmembers Crain, Sisk, Vasiliou and Zitur The following voted against or abstained: none Whereupon the Resolution was declared duly passed and adopted.
