Pursuant to due call and notice thereof, a Regular meeting of the City Council of
the City of Plymouth, Minnesota, was held on the 5th day of May . 1966.
The following members were present: Mayor Schne—icer, Councilmem ers rain,
Sisk, Vasiliou and Zitur
The following members were absent: none
Councilmember Crain introduced the following Resolution and moved its
adoption:
RESOLUTION NO. 86-252
DIRECTING RESPONSE TO ENVIRONMENTAL QUALITY BOARD (EQB) NOTICE OF PETITION REQUESTING
ENVIRONMENTAL ASSESSMENT WORKSHEET (EAW) FOR LAKE PARK HEIGHTS (85089)
WHEREAS, pursuant to State law and State Environmental Quality Board Rules and Regula-
tions a petition was submitted requesting the preparation of an Environmental Assess-
ment Worksheet for the proposed development known as Lake Park Heights; and,
WHEREAS, the City of Plymouth has been designated the Responsible Governmental Unit for
determining whether an Environmental Assessment Worksheet is required and/or necessary;
and,
WHEREAS, the street connecting 31st Avenue with 29th Avenue has been eliminated; and,
WHEREAS, the extension of 31st Avenue has been routed to minimize filling of the
wetland; and,
WHEREAS, filling the wetland for a building site will be minimized; and,
WHEREAS, that portion of the illegal fill not necessary for a minimum -sized cul-de-sac
of 29th Avenue will be removed; and,
WHEREAS, a water level control device will be built to provide an overflow level of 936
feet; and,
WHEREAS, the State Environmental Quality Board regulations and standards for mandatory
preparation of Environmental Assessment Worksheets do not apply to this development;
and,
WHEREAS, the City Council approved the Final Plat for Lake Park Heights for Thomas
Graham, Graham Development Company, by Resolution No. 86-253 on May 5, 1986; and,
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MIN-
NESOTA, that it should and hereby does find that an Environmental Assessment Worksheet
does not need to be prepared or directed by the City as requested in the petition re-
ceived through the State Environmental Quality Board for the following reasons:

1. The standards and threshholds of the State Environmental Quality Regulation for
Mandatory EAW preparation do not apply to this development.
2. The plans and information for this proposed development have been thoroughly
reviewed by the City and have been found to be consistent with City plans and
codes.
3. The developer, Graham Development Company, has submitted a revised Final Plat
which does not result in significant negative impacts on the area.
FURTHER, a copy of this Resolution shall be directed to the State Environmental Quality
Board in respor,:;e to the Notice of Petition.
The motion for adoption of the foregoing Resolution was duly seconded by
Councilmember Sisk_,,and upon vote being taken thereon, the following
voted in favor thereof: mayor cneider, Councilmembers Crain,
Sisk, Vasiliou and Zi ur he following
voted against or abstained: none Whereupon the
Resolution was declared duly passed and adopted.
