due call and notice thereof, a Regular meeting of the City

Councilmember Sisk introduced the following Resolution and moved
its adoption:
RESOLUTION NO. 86- 236
REQUEST FOR PAYMENT NO 2 AND FINAL
PROJECT NO. 011
NATHAN LANE SANITARY SEWER
WHEREAS, the City of Plymouth as owner and Nodland Associates, Inc., as
contractor have entered into an agreement for the Nathan Lane Sanitary Sewer
Project, City Project No. 011, sai"' agreement being dated December 13, 1984;
and
WHEREAS, the engineer has certified his acceptance of the work and his approval
of the final request for payment:
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA:
1. That the original contract amount was $65,977.00, and the value of
the work to date is $58,426.34.
2. That the work performed by the contractor for the Nathan Lane
Sanitary Sewer is certified to the Council by the engineer as
acceptable be and the same is hereby released from the contract
except as to the conditions of the performance bond, any and all
legal rights of the owner, required guarantees and correction of
faulty work after final payment.
3. Request for Payment No. 2 and Final in the amount of $8,227.30 to
Nodland Associates, Inc. for the Nathan Lane Sanitary Sewer is
hereby approved and the City Finance Director is hereby authorized
and directed to pay the same forthwith.
The motion for the adoption of the foregoing Resolution was duly seconded by
_ MUQC Schneider , and upon vote being taken thereon, the
following voted in favor thereof: Mayu r Schneider, Councilmembers
Crain, Sisk, Vasiliou and Zitur
The following voted against or abstained: none
Whereupon the Resolution was declared duly passed and adopted.
