HomeMy WebLinkAboutCity Council Resolution 1986-2090 CITY OF PLYMOUTH Pursuant to due call and notice thereof, a gpogular meeting of the City Council or the City of Plymouth, Minnesota, was held on the 21st day of April 1. The following members were present: � _ Sisk. Vasiliou and Zitur We - following members were absent: none Cour.cilmember Sisk intrruced the following Resolution and moved its adoption: RESOLUTION NO. 86-209 APPROVING PRELIMINARY PLAT AND VARIANCE FOR JEFFREY LAUX FOR LAUX ADDITION" (86022) WHEREAS, Jeffrey Laux has requested approval for a Preliminary Plat and Variance for two single family residential lots at 12916 County Road 15; and, WHEREAS, the Planning Commission has reviewed the request at a duly called Public Hear- ing and recommends approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MIN- NESOTA, that it should and hereby does approve the Preliminary Plat and Variance for Jeffrey Laux for "Laux A61ition" for two single family residential lots at 12916 County Road 15, subject to the following conditions: 1. Compliance with the City Engineer's Memorandum. 2. No Building Permits shall be issued until a Contract has been awarded for sewer and water. 3. Payment of park dedication fees -in -lieu of dedication in accordance with the Dedi- cation Policy in effect at the time of filing the Final Plat. 4. Compliance with Policy Resolution No. 79-80 regarding minimum floor elevations for new structures in subdivisions adjacent to, or containing any open storm water drainage facility. 5. No Building Permits shall be issued until the Final Plat is filed and recorded with Hennepin County. 6. No yard setback variances are granted or implied. 7. Approved variance for lot width of 92 ft. vs 110 ft. for Lot 2, on the basis of the shape of the lot and similarity to other parcels in this area. S. Driveway access shall be limited to the west lot area, to be approved by the City Engineer prior to issuanc of a building permit; a "T" shall be provided to pre- vent backing out onto Cour y Road 15. PLEASE SEE PAGE TWO Page two Resolution No. 86- 209 9. Appropriate legal documents and covenants shall be filed on Lot 2, citing the development constraints of easements; reduced buildable area; setback provisions; and, restricted driveway location. No variances are granted or implied. 10. Prior to filing a Final Plat at Hennepin County, appropriate legal documents, including written statements from the IRS agencies, shall be provided and approved by the City Attorney, to demonstrate the resolution and/or satisfaction of the Title concerns. The motion for adoption of the foregoing Resolution was duly seconded by Councilmember Zitur and upon vote being taken thereon, the following voted in favor thereof: r4ayor ScHnedder, Councilmembers Crain, Sisk, Vasiliou and Zitur The following voted against or abstained: none ghereupon the Resolution was declared duly passed and adopted.
