HomeMy WebLinkAboutCity Council Resolution 1986-1890 CITY OF PLYMOUTH Pursuant to due call and notice thereof, a Regular meeting of the City Council of the City of Plymouth, Minnesota, was held on the 7th day of April 19&. The following members were present: Mayor Schneider_ Lou,,&-;',.:L.,ihers Crain_ The 1011001109 members were absent: Councilmember Sisk Councilmember Crain introduced the following Resolution and moved its adoption: RESOLUTION NO. 86- 189 APPROVING SITE PLAN, CONDITIONAL USE PERMIT AND VARIANCES FOR JAMES YUNGNER, "WARRIOR ONE -THE GYM" (86020) WHEREAS, James Yungner has requested approval of a Site Plan, Conditional Use Permit, and Variances for the construction of an approximate 12,750 sq. ft. health and fitness center at 28th Place and Glacier Lane; and, WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval; and, WHEREAS, this request supersedes the approval granted under Resolution No. 85-846 adopted on October 21, 1985 (85086); NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MIN- NESOTA, that it should and hereby does approve the request for James Yungner for Site Plan, Conditional Use Permit, and Variances for the construction of an approximate 12,750 sq. ft.. health and fitness center at 28th Place and Glacier lane, subject to the following conditions: 1. Compliance with City Engineer's Memorandum 2. Payment of park dedication fees -in -lieu of dedication in accordance with the Dedi- cation Policy in effect at the time of Building V ermit issuance. 3. Submission of required financial guarantee and Site Performance Agreement for com- pletion of site improvements. 4. All signage shall be in compliance with the Ordinance. S. Any subsequent phases or expansions ire subject to required reviews and approvals per Ordinance provisions. 6. All waste and waste containers shall be stored within the enclosure and no outside storage is permitted. ' 7. The permit is subject to all applicable codes, regulations d Ordinances, and %solation thereof shall be grounds for revocation. 8. The permit is issued to James Yungner, The Gym, as operator of the facility and shall not be transferable. The facility includes free -weightlifting. PLEASE SEE PAGE TWO Page two Resolution No. 86-189 9. The site shall be maintained in a sanitary manner. 10. All parking shall be off-street in designated areas. 11. A covenant shall be filed on the property as approved by the City Attorney, notifying that a variance related to Ordinance required parking has been approved which may limit or restrict the future use of this site. 12. The use of this property shill not change in nature without City approval, to include analysis of impact or, parking needs and circulation. 13. On-site traffic directional signage shall be used to chance circulation. 14. Should in the future this use no longer function in this building,s the best alternate use is de caned Lo be an office. 16. The General Development Plan is amended to comprehend this use in -lieu of an office building on this site. 17. Approved variances include an 8 ft., 10 ft., and 11 ft. setback to the parking spaces from the north property line, rather than the 20 ft. Ordinance required setback; 8 ft. setback to the north property line for the drive aisle, versus the 10 ft. Ordinance required setback; and, a variance for 114 parking spaces versus the 228 parking spaces required by the Ordinance is 114 space deficiency). 18. The variance for parking capacity is granted due to the unique nature of activity at this facility, specifically c,ppealing to porar lifters and other serious athletes. It is envisioned that no more than 100 persons will occupy the building at any one time. 19. Resolution No. 85-846 is hereby rescinded.
