Pursuant to due call and notice thereof, a Regular meeting of the City
Council of the City of Plymouth, Minnesota was held on the 7th day
of_ARril , 1986. The following members were present:
Mayor Schneider, Councilmembers Crain, Sisk, Vasiliou and Zitur
The following members were absent: none
Mayor Schneider _ introduced the following Resolution and moved
its adoption:
RESOLUTION TSO. 86- 181
AUTHORIZING THE VACATION OF STREET RIGHT-OF-WAY
ORCHARD AVENUE ADJACENT TO LOTS 2, 3, 4 AND 5, BLOCK "A"
PLYMOUTH ORCHARDS ADDITION
WHEREAS, a petition was received to vacate a portion of Orchard Lane; and
WHEREAS, a public hearing with :espe,t t-) said vacation was scheduled for and
held on April 7, 1986 in accordance w;-th Minnesota Statutes 412.851 as amended;
and
WHEREAS, a notice of publication of said hearing was published and posted two
weeks prior to the meeting of April 7, 196; and
WHEREAS, the Council did hold a public hearing on April 7, 1986 to inform any
and all interested parties relevant to the vacation of said Orchard Lane; and
10 WHEREAS, it was determined by the City Council that said right-of-way for
Orchard Lane as described below is not needed for public street;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA:
1. That a portion of Orchard Lane described as follows is hereby vacated:
That part of Orchard Avenue lying between the Southerly extension
of the East line of Lot 2, Block A, "Plymouth Orchards Hennepin
Co., Minn.", according to the recorded plat thereof, and the
Easterly line of previously vacated 15th Avenue North.
2. The City shall reserve a utility easement over said vacated street.
The motion for the adoption of the foregoing lesolution was duly seconded by
Councilpgiber Crain and upon vote being taken thereon, the
