Pursuant to due call and notice thereof, a Snor;27 meeting of the City
Council of the City of Plymouth, Minnesota was held on the '23 rt day of

its adoption:
RESOLUTION NO. 86- 165
REQUEST FOR PAYMENT NO 2 AND FINAL
SALT STORAGE BUILDING
WHEREAS, the City of Plymouth as owner and Demars and Touhey Constriction,
Mankato, Minnesota as contractor have entered into an agreement for the
construction of a salt storage building, said agreement being dated December 9,
1985; and
WHEREAS, the engineer has certified his acceptance of the work and his approval
of the final request for payment:
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA:
1. That the original contract amount was $71,391 and the value of the
work to date is $71,391.
® 2. That the work performed by the contractor for the construction of a
salt storage building and certified to the Council by the engineer
as acceptable be and the same is hereby accepted as of March 31,
1986. The Contractor is hereby released from the contract except
as to the condtions of the performance bond, any and all legal
rights of the owner, required guarantees and correction of faulty
work after final payment.
3. Request for Payment No. 2 and Final in the amount of $7,139.10 to
Demars and Touhey Construction, for the Improvement is hereby
approved and the City Finance Director is hereby authorized and
directed to pay the same forthwith.
The motion for she adoption of the foregoing Resolution was duly seconded by

Whereupon the Resolution was declared duly passed and adopted.
