The following members were present: Mayor Schnei er, ouncilmember5 Crain, Sisk, Vasiliou and Zitur TQ following members were absent: none i IFiF iF# it **4 Councilmember Crain introduced the following Resolution and moved its adoption: RESOLUTION NO. 86- 160 APPROVING A CONDITIONAL USE PERMIT FOR MERCHANDISING SERVICE FOR RICHARD J. BORDEN AT 9628 6TH AVENUE NORTH (86015) WHEREAS, Richard U. Borden has requested a Conditional Use Permit to allow merchan,':�- ing services from his offices at 9628 6th Avenue North in the B-1 (office limited bus- iness) Zoning District; and, WHEREAS, the Planning Commission has reviewed said request at a duly called Public . Hearing and recommends approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MIN- NESOTA, that it should and hereby does approve the request for Richard O. Borden for a Conditional Use Permit to allow merchandising services from his offices at 9628 6th Avenue North, subject to the following conditions: 1. The permit is subject to all applicable codes, regulations and Ordinances, and violation thereof shall be grounds for revocation. 2. The permit is issued to Richard Borden as operator for philatelic merchandising and shall not be transferable. 3. The site shall be maintained in a sanitary manner. 4. Any signage shall conform with the City Ordinance standards for traffic direc- tional purposes only. 5. There shall be no exterior business signage on the property relative to the con- ditional use. 6. There shall be no outside display, sales, or storage of merchandise or related materials. PLEASE SEE PAGE TWO .Page two Resolution No. 86-160 7. The permit shall be renewed in one year to assure compliance with the conditions. S. Compliance with applicable Building and Fire Code requirements shall be verified by the City prior to Permit issuance, including the posting of a maximum occupant load for 50 people. 9. All parking shall be off-street in designated areas which comply with the Zoning Ordinance. 10. This Permit allows a maximum of three stamp auctions per year to be conducted only on Saturdays. The notion for adoption of the foregoing Resolution was duly seconded by Councilmember Vasiliou , and upon vote being taken thereon, the following voted in favor thereof: Mayor ScReider, Councilmembers Crain, Sisk, Vasiliou and Zitur The following voted against or abstained: none Whereupon the . Resolution was declared duly passed and adopted.
