HomeMy WebLinkAboutCity Council Resolution 1986-078CITY OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota, was held on the 3rd day of February , 19K. The following members were present: Mayor Schneider. Councilmembers Crain. Sisk. Vasiligg and Zitur The following members were absent: none adoption: �s �w Introduced the following Resolution and mored its RESOLUTION NO. 86-78 DENIAL OF A CONDITIONAL USE PERMIT AMENDMENT FOR A REDUCED SETBACK AT 4850 ORLEANS LANE (85139) (RPUD 77-1) WHEREAS, Thomas Kasperzak has requested a Conditional Use Permit Amendment for a reduced Setback from 10 ft. to 7 ft., to permit an addition to the residence at 4850 Orleans Lane; and, WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends denial; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does deny the request for Thomas Kasperzak for a Conditional Use Permit Amendment for a reduced Setback for the following reasons: 1. It has not been demonstrated that there is a uniqueness or hardship to warrant the reduced setback. 2. Alternate designs would allow compliance with the minimum setbacks. 3. The proposal is not consistent with the character of the Planned Unit Development. The motion for adoption of the foregoing Resolution was duly amm led by Councilmember Sisk , and Loon vote being taken WiSmaeont t e following voted In favor thereof: Mayor Schneider, Councilmembers Crain, Sisk, Vasiliou and Zitur The following voted against or abstained: none thereupon the Resolution was declared duly passed and adopted.
