HomeMy WebLinkAboutCity Council Resolution 1986-076CITY OF PLYMOUTH Pursuant to due call and notice thereof, a reclular meeting of the City Council of the City of Plymouth, Minnesota, was held on the 3rd day of February , 1986. The following members were present: Mayor Schneider. Councilmembers Crain, sk, — Vasiliou and Zitur The following members were absent: none �f rnunrilmamher Crain introduced the following Resolution and moved its adoption: RESOLUTION NO. 86-76 APPROVING A SITE PLAN AND CONDITIONAL USE PERMIT FOR SIM DOMORACKI, FIRST EDITION COR- PORATION (85128) WHEREAS, dim Domoracki, First Edition Corporation, has requested a Site Plan and Con- ditional Use Permit for the vonstruction of a Class I Restaurant on Lot 2, Block 1, Elwell Miley and Quinn Addition, east of Empire and Harbor Lanes; and, WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COLWCIL OF THE CITY OF PLYMOUTH, MIN- NESOTA, that it should and hereby does approve the request for dim Oonoracki, First Edition Corporation, for a Site Plan and Conditional Use Permit for the construction of a Class I Restaurant east of Empire and Harbor Lanes, subject to the following conditions: 1. Compliance with City Engineer's Memorandum 2. Payment of park dedication fees -in -lieu of dedication with appropriate credits In an amount determined according to the Dedication Policy in effect at the time of Building Permit issuance. 3. Provisions for a 20 -ft. wide trail easement per Comprehensive Park Plan, as veri- fled by the Parks and Engineering Departments prior to issuance of a building permit. 4. Submission of required financial guarantee and Site Performance Agreement for com- pletion of site improvements. 5. Signage shall be in compliance with the Ordinance and approved site plan. 6. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. 7. All waste avid waste containers shall be stored within the enclosure and no outside storage is permitted. S. No Building Permit to be issued until the Final Plat is filed and recorded with Hennepin County. 0 PLEASE SEE PAGE TWO Page two Resolution No. 86- 76 . 9. The permit is issued to the First Edition Corporation as operator of the facility and shall not be transferable. 10. The site shall be maintained in a sanitary manner. 11. There shall be no outside display, sales, or storage of merchandise or related materials. 12. All parking shall be off-street in designated areas which comply with the Zoning Ordinance. The motion for adoption of the foregoing Resolution was duly seconded by Councilmember Si k, and upon vote being taken thereon, the following voted in favor thereof: Mayor c neider, Councilmembers Crain, Sisk, Vasilipu and Zitur • The followinq voted against or abstained: none Whereupon the Resolution was declared duly passed and adopted.
