HomeMy WebLinkAboutCity Council Resolution 1986-071CITY OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota, was held on the 3rd day of February_, 19. The following members were present:MaY.Q r Schneider. Councilmembers Crain. Sisk. _Vasiliou and 7itur .The following members were absent: none Councilmember Vasiliou introduced the following Resolution and moved its adoption: RESOLUTION NO. 86-71 APPROVING SITE PLAN AND SETTING CONDITIONS FOR FILING THE LOT DIVISION FOR OPUS CORPORATION (85125) WHEREAS, Opus Corporation has requested approval of a Site Plan for the construction of an office warehouse facility east of Niagara Lane and north of 28th Avenue North; and, WHEREAS, the Planning Commission has reviewed said request and recommends approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MIN- NESOTA, that it should and hereby does approve the request by Opus Corporation for a Site Plan to construct an office warehouse facility and sets the conditions to be met before filing the Lot Division for property east of Niagara Lane and north of 28th Avenue North, subject to the following conditions: 1. Compliance with City Engineer's Memorandum 2. Payment of park dedication fees -in -lieu of dedication in accordance with the Dedi- cation Policy in effect at the time of Building Permit issuance. 3. Submission of required financial guarantee and Site Performance Agreement for com- pletion of site improvements. 4. Sign program shall be reviewed and approved by the Planning Commission and City Council prior to issuance of a Sign Permit. 5. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. 6. All waste and waste containers shall be stored within the structure and no outside storage is permitted. 7. No Building Permit to be issued until the Lot Division is filed and recorded with Hennepin County. 8. Appropriate legal documents, as approved by the City Attorney, shall be filed on both parcels at Hennepin County allowing for the shared use of driveways, parking spaces and hydrants. The documents should specifically identify that 17 parking spaces on "Phase 1" are encumbered for the use of "Phase 211. The motion for adoption of the foregoing Resolution was duly seconded by Councilmember Sisk , and upon vote being taken thereon, the following voted in favor thereof: Mayor Schneider, Councilmembers Crain, Sisk, Vasiliou and Zitur following voted against or abstained: none Whereupon the Resolution was declared duly passed and adopted.
