HomeMy WebLinkAboutCity Council Resolution 1986-016CITY OF PLYMOUTH ORDINANCE NO. 86-16 AN ORDINANCE AMENDING THE ZONING ORDINANCE TO CLASSIFY CERTAIN LANDS OF LOCATED WEST OF ZACHARY LANE, NORTH OF COUNTY ROAD 9 (4325 ZACHARY LANE) AS R -1A (LOW DENSITY SNGLE FAMILY RESIDENTIAL) DISTRICT. Section 1. Amendment of Ordinance. Ordinance 80-9 of the City of Plymouth, Minnesota, adopted June 15, 1980 as amended, is hereby amended by changing the classification on the City of Plymouth Zoning Map from FRD (future restricted development) District to R -1A (low density single family residential) District with respect to the hereinafter described property: That part of the Northeast Quarter of the Northeast Quarter of Section 14, Township 118, Range 22 described as beginning at a point on the East line of said Northeast Quarter of the Northeast Quarter a distance of 661.25 feet South from the Northeast corner thereof; thence West 569.49 feet at a right angle with said East line; thence South 378.99 feet parallel with said East line; thence Southeasterly to a point on said East line a distance of 436.33 feet South from the point of beginning; thence North to the point of beginning. Subject to an easement for Zachary Lane over the East 33 feet thereof. Section 2. General Development Plan. This Ordinance authorizes the development of said property only in accordance with the approved plan under File 86068, Section 3. Effective Date. Vi gll Schneider, Mayor CITY OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota was held on the 6th day of January 1986. The following members were present: Mayor Schneider, Councilmembers Sisk, Crain and Vasiliou The following members were absent: none Mayor Schneider introduced the following Resolution and moved its adoption: RESOLUTION NO. 86-16 REQUEST FOR PAYMENT NO 16 AND FINAL C.S.A.H. 61, XENIUM LANE AND POND BC-Pll - STREET IMPROVEMENTS PROJECT NO. 205 AND 123 WHEREAS, the City of Plymouth as owner and Veit and Company, Inc., as contractor have entered into an agreement for the C.S.A.H. 61, Xenium Lane and Pond BC -P]1 Street Improvement Projects, City Project No. 205 and 123, said agreement being dated June 29, 1983; and WHEREAS, the Engineer has certified his acceptance of the work and his approval of the final request for payment: NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: 1. That the original contract amount was $1,907,624.65, two (2) change orders were approved in the amount of $69,026.30 and the value of the work to date is $2,267,405.01. 2. That the work performed by the contractor for the C.S.A.H. 61, Xenium Lane and Pond BC-Pll Projects is certified to the Council by the Engineer as acceptable be and the same is hereby released from the contract except as to the conditions of the performance bond, any and all legal rights of the owner, required guarantees and correction of faulty work after final payment. 3. Request for Payment No. 16 and Final in the amount of $6,600.00 to Veit and Company, Inc. for the C.S.A.H. 61, Xenium Lane and Pond BC-Pll Projects is hereby approved and the City Finance Director is hereby authorized and directed to pay the same forthwith; and the City Finance Director is authorized to return to the contractor his $80,000.00 certificate of deposit which is on file with the City. The motion for the adoption of the foregoing Resolution was duly seconded by Councilmember Sisk , and upon vote being taken thereon, the . following voted in favor thereof: Mayor Schneider, Councilmembers Sisk, Crain and Vasiliou The following voted against or abstained: none Whereupon the Resolution was declared duly passed and adopted.
