AN ORDINANCE RELATING TO STATE LAWS AND
CODES; REPEALING PLYMOUTH CITY CODE,
SUBSECTION 100.07: ADDING A NEW SUBSECTION.
THE CITY COUNCIL OF THE CITY OF PLYMOUTH ORDAINS: '
Section 1. Plymouth City Code is amended by adding a
new subsection to read:
0100.08. Official Statutes: Codes, Recaulationss
Minnesota statutes are to Minnesota statutes 1994
Minnesota Statutes, 1985 Supplement,and Laws
1986. unless otherwise provided n s C e.
municivalities are to those documents in effect on
Sec. 2. Plymouth City Code, Subsection 100.07 is
repealed.
Sec. 3. This ordinance is effective in accordance With
Plymouth City Code, Subsection 110.11.

CITY OF PLYMOUTH
Pursuant to due call and notice thereof, a regular meeting of the City Council of
the City of Plymouth, Minnesota, was held on the 6th day of January 19.
The following members were present: Mayor Schneider. Councilmembers Sisk. Crain
and Vasiliou
The following members were absent: none
Mayor Schneider introduced the following Resolution and moved its
adoption:
RESOLUTION NO. 86-13
APPROVING A CONDITIONAL USE PERMIT FOR MARTIN KLATTE FOR ELM CREEK WINTER PARK (85133)
WHEREAS, Martin Klatte has requested a Conditional Use Permit for Elm Creek Winter Park
for the seasonal operation of a snow tubing facility at 18940 Highway 55; and,
WHEREAS, the Planning Commission has reviewed said request at a duly called Public
Hearing and recommends approval;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYHO!1TH, MIN-
NESOTA, that it should and hereby does approve the request by Martin Klatte for a
Conditional Use Permit for Elm Creek Winter Park for a seasonal operation of a snow
tubing facility at 18940 Highway 55, subject to the following conditions:
1. The permit is subject to all applicable codes, regulations and Ordinances, and
violation thereof shall be grounds for revocation.
2. The permit is issued to Martin Klatte as operator of the facility and shall not be
transferable.
3. The site shall be maintained in a sanitary manner.
4. Any signage shall conform with the City Ordinance standards.
5. There shall be no outside display, sales, or storage of merchandise or related
materials.
6. The permit shall be renewed in one year to assure compliance with the conditions.
7. All parking shall be off-street in designated areas which comply with the Zoning
Ordinance.
The motion for adoption of the foregoing Resolution was duly seconded by
Councilmember Vasiliou and upon vote bet" taloen thereon, the
