HomeMy WebLinkAboutCity Council Resolution 1986-012ORDINANCE NO. 86- 12 AN ORDTNANCE RELATING TO LICENSE FEES, PERMIT FEES AND OTHER FEES AND CHARGES; AMENDING PLYMOUTH CITY CODE, SUBSECTIONS 1010.01, 1015.07, 1015.11, 1015.13, 1015.17, 1015.19, 1015.21, 1015.23 AND 1015.27 THE CITY COUNCIL OF THE CITY OF PLYMOUTH ORDAINS: Section 1. Plymouth City Code, Subsection 1010.01, is amended to read as follows: 1010.01. Fees. Subdivision 1. Fees set. The fees for the various licenses required by this Code are set forth in this subsection under the headings listed for subdivisions 2 through 7. Type of License Section Requiring License Subd. 2. Plymouth City Code, Subsection 1015.07, is amended by adding of the following subdivision: Subd. 3. Refunds. Application fees say not be refunded unless the appli- cation is withdrawn vrior to its referral to the Planning Comission by the City Sec. 3. Plymouth City Code, Subsection 1015.11, Subdivision 2(a) is amended to read as follows: (a) Plan review fees. Plymouth City Code, Subsection 1015.13, is amended to read as follows: 1015.13. Plumbing. Plumbing permit procedures and fees are as follows. It shall be unlawful for any person to perform work subject to the Building Code for which a permit is required without first obtaining a permit therefor from the City; such permits shall be issued by the City only to persons licensed as plumbers by the State and registered as such with the City or to persons making application to do any such work wholly within a residence owned and occupied by the applicant to whom the permit is to be issued and who shall be charged the following as permit fees: (a) Permit fee Or% 10.00 Residential $48x88 15.00 Commercial/Industrial (b) Each fixture and fixture opening $ 4x88 7.00 (c) Each future fixture opening $ 4.00 (d) Installation of fixture on future openings $ 3.00 (e) Water heating device $ rlr88 7.00 (f) Water conditioning device $ 6r88 7.00 (g) Septic systems and/or drainfield $20.00 (h) Yard sprinkler $15.00 (1) Rain water leader $ 5r88 7.00 (j) Swimming pool piping $20.00 (k) Gas piping 2.00 per appliance outlet (1) For each permit for the alteration of or repairing of existing plumbing and for other plumbing work not included above the fee shall be $7.00 for the first $100.00 or fraction thereof in the estimated cost of such proposed work; for each additional $100.00 or fraction thereof in such estimated cost. $3.00 shall be added to the above prescribed fee for such permit. Sec. 5. Plymouth City Code, Subsection 1015.17, is amended to read as follows: 1015.17. Heating, Air Conditioning, Ventilation, and Refrigeration Fees. (a) For the installation of any central heating and/or air conditioning system, the fee shall be 12 of the estimated cost. The minimum fee shall be $28.88 30.00 for any such central system. (b) For additional alterations or repairs to any central system, the permit fee shall be 12 of the estimated cost. The minimum permit fee shall be OvN 15.00. (c) For each appliance or piece of equipment regulated by the Code, but not classed in other appliance categories or for which no other fee is listed in this Code, the fee shall be 1% of the estimated cost. The minimum permit fee shall be $& AA 15.00. Sec. 6. Plymouth City Code, Subsection 1015.19, is amended to read as follows: 1015.19. Water and Sanitary Sewer Permit Fees. Subdivision 1. Plymouth City Code, Subsection 1015.21, is amended to read as follows: 1015.21. Other Permit Fees and Charges. Plymouth City Code, Subsection 1015.23, is amended to read as follows: 1015.23. Zoning and Subdivision Fees; Special Provisions. Subdivision 1. Scope and Application. This Subsection applies to applications for the platting or replatting of land and variances from platting regulations made pursuant to Section 500 of this Code, and to applications for zoning district changes, zoning code text amendments, conditional use permits, and variances, made pursuant to the Zoning Code (Appendix I of this Code). Reduced Site Plan Review Fees. The fee for Site Plan review shall be 50% of the Site Plan review fee provided in Subdivision 2 under the following circumstances: (a) When plans are submitted after the City Council approval has either expired or has been extended but where no substantive changes have been made to the plans other than required by this Code or Ordinance, in accordance with the Plymouth Zoning Ordinance. (b) When plans have been submitted proposing minor structural and/or minor site expansions or modifications as provided by the Plymouth Zoning Ordinance. Sec. 9. Plymouth City Code, Subsection 1015.27, is amended to read as follows: 1015.27. Tanks Containing Flammable or Combustible Liquid or Gas: Fees. (a) For the installation of fuel oil storage tank only for use in con- nection with an oil burner installation where such tanks are buried or otherwise enclosed, the permit fee shall be #b*9A 6.00 for each tank less than 1,000 gallons and $SAr88 12.00 for each tank 1,000 gallons or more. (b) For the installation of a fuel oil storage tank or tanks only, for use in connection with an oil burner, not underground or otherwise en- closed, the permit fee shall be $3r8A 4.00 per tank. (c) For the installation, modification, removal, or abandonment of any under- or above -ground tank, other than a fuel oil storage tank, which will contain a flammable or combustible liquid or gas, other than L.P. gas or fuel oil tanks used for heating, the permit fee shall be 346Sr8A 18.00 for each above -ground tank, $59r8A 60.00 for each underground tank, and $;r3@ 9.00 for the installation or alteration of piping. (d) Liquid Propane Facilities: For the installation, alteration, modi- fication, relocation, or replacement of any non-portable propane or L.P. gas storage facility or portion thereof the permit fee shall be: (1) For each storage tank OF -MOO 18.00 (2) For each vaporizer ;TSO 9.00 (3) For gas piping ;r56 9.00 Sec. i0. Crain and V4siliou The ToIlLowing members were absent: none �t �w wff Counci_lmember Crain introduced the following Resolution and moved its adoption: RESOLUTION NO. 86-12 APPROVING SITE PLAN AND VARIANCES AND SETTING CONDITIONS FOR LOT CONSOLIDATION FOR WELSH CONSTRUCTION COMPANY (85132) WHEREAS, Welsh Construction Company has requested approval of a Site Plan, Lot Con- solidation, and Variances to construct a neighborhood shopping center on approximately 6.7 acres located at the southwest corner of County Road 6 and State Highway 101; and, WHEREAS, the Planning Commission has reviewed said request and recommends approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MIN- NESOTA, that it should and hereby does approve the request for Welsh Construction Com- pany to construct a neighborhood shopping center on approximately 6.7 acres located at the southwest corner of County Road 6 and State Highway 101, subject to the following conditions: 1. Compliance with City Engineer's Memorandum 2. Payment of park dedication fees -in -lieu of dedication in accordance with the Dedi- cation Policy in effect at the time of Building Permit issuance. 3. Submission of required financial guarantee and Site Performance Agreement for com- pletion of site improvements. 4. Signage shall be in compliance with the Ordinance and shopping center tenant sign- age program. 5. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. 6. All waste and waste containers shall be stored within the enclosure and no outside storage is permitted. 7. No Building Permit to be issued until the Consolidation is filed and recorded with Hennepin County. S. Variances are approved from the the building setback to Olive Lane (55 ft. vs Ord- inance standard 75 ft.) parking space setbacks to the building (0 and 5 ft. vs Ordinance standard 10 ft.); drive aisle setback to the building (0 and 5 ft. vs Ordinance standard 10 ft.); parking setback at the corners of County Road 6 and Olive Lane, County Road 6 and 101, and Highway 101 and 14th Avenue North (0 ft. vs Ordinance standard 20 ft.); and, freestanding signs setbacks (2 ft. vs Ordinance standard 20 ft.) on the basis that the site has four front yards, angled right-of- way at the corners, and considering the petitioner's efforts to provide compensa- tory landscaping. PLEASE SEE PAGE TWO .Page two Resolution No. 86-12 9. The site shall be maintained in a sanitary manner. 10. There shall be no outside display, sales, or storage of merchandise or related materials. Should the petitioner fail to comply with this provision, store management shall be notified on the irregularity and given 24 hours to comply. In the event store management does not comply, the City shall proceed with the necessary corrective work and assess the cost against the property. 11. Trash Compactor area shall be screened by a wall, with increased screening of the loading dock entrance. 12. That the landscape plan shall reassign the proposed number of coniferous plantings to 85 with concentrations on the Olive Lane side of the site, specifically around the loading and trash storage areas; and, use Evergreens to shield the adjacent properties from headlight glare from delivery vehicles. 13. All coniferous trees shall be 10 ft. in height at planting. 14. All deliveries and trash pick-ups shall be restricted to between 7:00 A.M. and 10:00 P.M.
