HomeMy WebLinkAboutCity Council Resolution 1986-008CITY OF PLYMOUTH ORDINANCE NO. 86-08 AN ORDINANCE AMENDING THE CITY CODE SECTION 1140 RELATIVE TO SOLICITORS, PEDDLARS, AND TRANSIENT MERCHANTS THE CITY COUNCIL OF THE CITY OF PLYMOUTH DOES HEREBY ORDAIN AS FOLLOWS: Section 1. 1140.01 Definitions is hereby amended by the deletion of Subdivision 4 In its entirety and the addition of the following: Subd. 4. Transient Merchant--- Any person, individual, co -partnership, incorporation, both as principal and agent, who engages in, does, or transacts any temporary and transient business selling goods, wares, and merchandise; and, who for the purpose of carrying on such business has compiled with the licensing requirements of the City ode, and hires, leases, occupies, or uses a building, structure, vacant lot, motor vehicle trailer, or railroad car in a zoning district where it is allowed b this Ordinance. Section 3. 1140.05. Conditions Governing Registration is hereby amended by the addition of the following: ( Written statement of permission from fee owner of property where transient sales are to be held. This Ordinance shall take effect after its passage and publication on August 15, 1986. Crain ...� following members were absent: none ftf Councilmember Crain introduced the following Resolution and moved its adoption: RESOLUTION NO. 86-08 APPROVING SITE PLAN AND VARIANCE FOR INSTRUMENT CONTROL SYSTEMS, INC. (85124) WHEREAS, Instrument Control Systems, Inc. has requested approval of a Site Plan and Variance to use an existing building at 13005 16th Avenue North for office/warehouse on a temporary basis until a new building is constructed; and, WHEREAS, the Planning Commission has reviewed said request at and recommends approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MIN- NESOTA, that it should and hereby does approve the request for Instrument Control Systems, Inc. for a Site Plan and Variance for property at 13005 16th Avenue North, subject to the following conditions: 1. Compliance with City Engineer's Memorandum 2. Submission of required financial guarantee and Site Performance Agreement for com- pletion of site improvements prior to occupancy. 3. Bituminous surface installation may be deferred until dune 1, 1986. 4. Any signage shall be in compliance with the Ordinance. 5. Any subsequent phases c- expansions are subject to required reviews and approvals per Ordinance provisions. 6. All waste and waste containers shall be stored within the structure and no outside storage is permitted. 7. Approved variance includes building side yard setback of 0' vs. 351, and two vari- ances from the Fire Code, regarding the location of the hydrant and the Fire Lane requirements. 8. Revised plans shall be submitted per December 2, 1985 correspondence prior to occupancy of the huilding. 9. That approval is conditioned upon a letter from the Fire Chief endorsing these variances from the Fire Code.
