HomeMy WebLinkAboutCity Council Resolution 1985-940CITY OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota, was held on the Zd day of December 1985. The following members were present: MayorDayenport�ounciInembers NeiIs, _ Schneider and Crain ' The following members were absent: Councilmember Vasiliou t+� .fir �rir Councilmember Neils introduced the following Resolution and moved its adoption: RESOLUTION NO. 85- 940 APPROVING PRELIMINARY PLAT, CONDITIONAL USE PERMIT AND VARIANCES FOR MICHAEL ANDERSON FOR ANDERSON'S PHEASANT TRAIL (95103) WHEREAS, Michaei Anderson has requested approval for a Preliminary Plat, Rezoning, Conditional Use Permit, and Variances for Anderson's Pheasant Trail for three single family residential lots, and 24 townhouse units on 21.31 acres located east of 53rd Avenue and Ximines Lane; and, WHEREAS, the Planning Commission has reviewed the request at a duly called Public Hearing and recommends approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the Preliminary Plat, Conditional 10 Use Permit, and Variances for Michael Anderson for Anderson's Pheasant Trail located east of 53rd Avenue and Ximines Lane, subject to the following conditions: 1. Compliance with the City Engineer's Memorandum. 2. Removal of all dead or dying trees from the property at the owner's expense. 3. No Building Permit- ,hall he issued until a Contract has been awarded for sewer and water. 4. Payment of park dedicationfees-in-lieu of dedication in accordance with the Dedication Policy in effect at the time of filing the Final Plat. 5. Street names shall comply with the City Street Naming System. 6. Compliance with Policy Resolution No. 79-80 regarding minimum floor elevations for new structures in subdivisions adjacent to, or containing any open storm water drainage facility. 7. Rezoning shall be finalized with filing of the Final Plat. S. No Building Permits shall be issued until the Final Plat is filed and recorded with Hennepin County. 09. No Building Permits for Lot 1, Block 4 until sanitary sewer and water are avail- able to service a dwelling. PLEASE SEE PAGE TWO Page two . Resolution No. 85- 940 10. Yard setbacks are: 35 ft. front yard; 15 ft. side yard; ?5 ft. rear yard for all structures and a 20 ft. setback to private drive for townhouse units. 11. Approved variances are: lots not having frontage on a public road; and town- house structure setback (35 ft. vs. 50 ft.) 12. Appropriate legal documents regarding Homeowner Association documents, covenants and restrictions as •pproved by the City Attorney, shall be filed with the Final Plat. 13. No further subdivision of Lot 1, Block 4 until such time that through Ordinance and Code required reviews it is demonstrated development can occur within mini- mum standards and respond positively to topography and soils conditions; within regulations established for protected wetlands and urban u'llities are available. 14. Lot 2, Block 3 shall be redesigned on the Final Plat to relocate the east prop- erty line so that minimum lot width of 90 ft. Is provided. 15. Information submitted with the Final Plat shall address neighborhood concerns regarding headlight glare due to the location of the private streets; coo sideration should be given to additional landscaping which would serve to mitigate headlight glare. The motion for adoption of the foregoing Resolution was duly seconded by Councilmember Crain , and upon vote being taken thereon, the following voted in favor thereof: Mayor avenport, Councilmembers Neils, Schneider and Crain The following voted against or abstained: none Whereupon the Resolution was declared duly passed and adopted.
