Pursuant to due call and notice thereof, a regular meeting of the City Council of
the City of Plymouth, Minnesota, was held on the 2nd day of December 1985.
The following members were present: Mayor Davenport, Council embers Neils,
Schneider and Crain
The following members were absent: Councilmember Vasillou

Councilmember Schneider introduced the following Resolution and moved its
adoption:
RESOLUTION NO. 85-939
APPROVING SITE PLAN, CONDITIONAL USE PERMIT, AND VARIANCES FOR JOE HAMM FOR HAMM BERG
ADDITION (85102)
WHEREAS, Joe Hamm has requested approval of a Site Plan, Conditional Use Permit, and
Variances for Hamm Berg Addition to be located southeast of 45th Avenue North and
Trenton Lane; and,
WHEREAS, the Planning Commission has reviewed said request at a duly called Public
Hearing and recommends approval;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MIN-
NESOTA, that it should and hereby does approve the request for Joe Hamm for a Site
Plan, Conditional Use Permit, and Variances for Hamm Berg Addition located southeast of
Rk 45th Avenue North and Trenton Lane, subject to the following:
1. Compliance with City Engineer's Memorandum
2. Payment of park dedication fees -in -lieu of dedication In accordance with the Dedi-
cation Policy in effect at the time of Building Permit issuance.
3. Submission of required financial guarantee and Site Performance Agreement for com-
pletion of site improvements.
4. Any signace shall be in compliance with the Ordinance.
5. Any subsequent phases or expansions are subject to required reviews and approvals
per Ordinance provisions.
6. Compliance with the Ordinance regarding the location of fire hydrants and fire
lanes.
7. All waste and waste containers shall be stored within the enclosure and no outside
storage is permitted.
8. No Building Permit to be issued until the Final Plat is filed and recorded with
Hennepin County.
9. Approved Variances include minimum front yard setback (35 ft. vs 50 ft.); a vari-
ance from the minimum side yard setback (15 ft. vs 25 ft.) for the dwellings; and,
' setback for the detached garages on Lots 1 3, and 4 (10 ft. vs 20 ft.) as
diagrammed on plan staff dated November 13, 1985.

10. The permit is subject to all applicable codes, regulations and Ordinances, and
violation thereof shall be grounds for revocation.
11. The site shall be maintained in a sanitary manner.
12. All waste end waste containers shall be stored within approved designated areas as
diagrammed on the pians dated November 13, 1985.
13. Any signage shall conform with the City Ordinance standards.
14. All parking shall he off-street in designated areas which comply with the Zoning
Ordinance.
15. The petitioner shall demonstrate that Outiot A, Hamm Berg Addition cannot be
combined with adjoining land in Woodlands and that Outlot E, Woodlands cannot be
combined with land in the Hamm Berg Addition; or, shall demonstrate a viable use
of proposed Outlot A, Hamm Berg Addition and/or through appropriate legal
documents as approved by the City Attorney, ownership of Outlot A, Hamm Berg
Addition is tied to this development orior to filing the final plat.
16. Six Evergreen trees, a minimum 6 ft. in height, shall be indicated on the approved
Landscape Plan and shall be installed along and adjacent to Trenton Lane.
The notion for adoption of the foregoing Resolution was duly seconded by
Councilmember Crain , and upon vote being taken thereat, the
following voted in favor thereof: Mayor Davenport, Councilmembers Neils,
Schneider and Crain

Whereupon the Resolution was declared duly passed and adopted.
