Pursuant to due call and notice thereof, a regular meeting of the City Council of
the City of Plymouth, Minnesota, was held on the 18th day of November , 1985.
The following members were present: Mayor Davenaort. Councilmembers Crain, Neils,
SchnSider and Vasiliou

Councilmember Neils Introduced the following Resolution and moved its
adoption:
RESOLUTION NO. 85-915
APPROVING PRELIMINARY PLAN/PLAT, CONDITIONAL USE PERMIT, AND VARIANCES FOR MICHAEL
FREUND FOR HERITAGE WEST 2ND ADDITION (95108)
WHEREAS, Michael Freund has requested approval for a Rezoning, Preliminary Plan/Plat,
Conditional Use Permit, and Variances for Heritage West 2nd Addition for 34 single
family residential lots on approximately 19.73 acres located northeast of 34th Avenue
and Xenium Lane; and,
WHEREAS, the Planning Commission has reviewed the request at a duly called Public
Hearing and recommends approval;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA, that it should and hereby does approve the Preliminary Plan/Plat, Con-
ditional Use Permit. and Variances for Michael Freund for Heritage West 2nd Addition
located northeast of 34th Avenue North and Xenium Lane, subject to the following
conditions:
1. Compliance with the City Engineer's Memorandum.
2. Removal of all dead or dying trees from the property at the owner's expense.
3. No Building Permits shall be issued until a Contract has been awarded for sewer
and water.
4. Payment of park dedicationfees-in-lieu of dedication in accordance with the
Dedication Policy in effect at the time of filing the Final Plat).
5. Street names shall cooly with the City Street Naming System.
6. Compliance with Policy Resolution No. 79-80 regarding minimum floor elevations
for new structures in subdivisions adjacent to, or containing any open storm
water drainage facility.
7. Rezoning shall be finalized with filing of the Final Plat.
8. No Building Permits shall be issued until the Final Plat is filed and recorded
with Hennepin County.
9. The variance is approved for an 800 ft. cul-de-sac vs the Ordinance maximum 500
ft.

10. No private driveway access shall be allowed to Xenium Lane.
11. Conditional use approval is granted for the development of 34 single family
detached homes consistent with the Preliminary Plat and General Development
Plan.
12. Yard setbacks shalt be a minimum of 35 ft. front yard from internal public
roadways; a 50 ft. front yard setback is proposed along Xenium Lane for Lots 1
and 26, Block 2 and Lots 1 and 4, Block 3; the minimum side yard setback is 10
ft.; and, the minimum rear yard setback is 20 ft.
13. The existing residence shall be removed from the site as part of the initial
development.
14. There shall be as little disturbance as possible relative to the grading and
filling for Lots 1, 2, 3, and 4, Block 1, of the first phase of development.
15. Final Plat shall include covenants on Outlot A (land other than Block 1, Lots 1
through 4) restricting use to single family detached homes as shown on the
Preliminary Plat received November 1, 1985.
16. The developer shall meet with representatives of School Districts 281 and 284
regarding possible transfer, from one District to the other, of Lots 1 through
4, Block 1.
The motion for adoption of the foregoing Resolution was duly seconded by
Councilmember Schneider , and upon vote being taken thereon, the
following voted in favor thereof: Mayor Davenport, Counci]members Crain, Neils,
Schneider end Vasi1iou

Whereupon the Resolution was declared duly passed and adopted.
