HomeMy WebLinkAboutCity Council Resolution 1985-913CITY OF PLYNO M Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota, was held on the 18th day of November , 1985. The following members were present: Mayor Davenport, Councilmembers Neils, Schneider, Crain and Vasiliou The following merbers were absent: None Councilmember Schneider introduced the following Resolution and moved its adoption: RESOLUTION NO. 85-913 DIRECTING RESPONSE TO ENVIRONMENTAL QUAVITY BOARD W QB) NOTICE OF PETITION REQUESTING ENVIRONMENTAL ASSESSMENT WORKSHEET (E,AW) EOR IVY PARK II DEVELOPMENT (84057) WHEREAS, pursuant to State law and State Environmental Quality Board Rules and Regula- tions a petition was submitted requesting the preparaL`on of an Environmental Assess- ment Worksheet for the proposed development known as Ivy Park II; and, WHEREAS, the City of Plymouth has been designated the Responsible Governmental Unit for determining whether an Environmental Asr.essment Worksheet is required and/or necessary; and, WHEREAS, the State Environmental Quality Board regulations and standards for mandatory preparation of Environmental Assessment Worksheets do not apply to this development; and, WHEREAS, the City has received correspondence from Enterprise Properties, the devel- oper, that they have decided to prepare an Environmental Assest-ment Worksheet for the development and that it will be submitted to the City for processing pursuant to the applicable State regulations; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MIN- NESOTA, that it should and hereby does fin,' that an Environmental Assessment Worksheet does not need, to be prepared or directed by the City as requested in the petition re- ceived throtg`t the State En%lronmentai Quality Board for the following reasons: 1. The standards and threshholds of the State Environmental Quality Regulation for Mandatory EAW preparation do not apply to this development. 2. The plans and information for this proposed development have been thoroughly re- viewed by the City and have been found to be cunsistent with City plans and codes. 3. The developer, Enterprise Properties, has submitted a letter confirming that the developer i:.; preparing a Voluntary Environmental Assessment Worksheet and will he submltti.no it for the required review process pursuant to State Environmental Quality Regulations. FURTHER, a -copy of this Resolution shall be directed to the State Environmental Quality Board in res4)onse to the Notice of Petition. The motion for adoption of the foregoing Resolution was duty seconded by Councilmember Vasillou , and upon vote being taken thereon, the following voted in favor thereof: 5 Ayes - Mayor Davenport, Councilmembers Crain, Neils_ Schneider and Vasiliou he following voted against or abstained: None Whereupon the Resolution was declared duly passed and a pt from the desk of �, GRACE WINEMN The attached Resolution approved by Council on 11/19 has been finaled because of the time frame needed to start the EAW process for this project. w-aftwr, Thank you.
