Pursuant to due call and notice thereof, a regular meeting of the City Council of
the City of Plymouth, Minnesota, was held on the 21st day of OctnhPr 19&5.
The following members were present: Councilmembers Crain, Neils, Schneider and
Vasiliou

RESOLUTION NO. 85-848
APPROVING SITE PLAN, CONDITIONAL USE PERMIT AND VARIANCES FOR DAVID C. JOHNSON FOR
BUILDING B (85094)
WHEREAS, David C. Johnson has requested a Site Pian, Conditional Use Permit, and
Variances to construct a gasoline service station including a carwash at the southwest
corner of Highway 101 and County Road 6; and,
WHEREAS, the Planning Commission has reviewed said request at a duly called Public
Hearing and recommends approval;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MIN-
NESOTA, that it should and hereby does approve the request for David C. Johnson for
Site Plan, Conditional Use Permit and Variances to construct a gasoline service station
including a carwash at the southeast corner of Highway 101 and County Road 6, subject
to the following:
1. Compliance with City Engineer's Memorandum
2. Payment of park dedication fees -in -lieu of dedication in accordance with the
Dedication Policy in effect at the time of Building Permit issuance, and
construction of sidewalks as verified by the Parks and Engineering Departments,
with submittal of detailed plans as to construction of the trail per City
standards.
3. Submission of required financial guarantee and Site Performance Agreement for
completion of site improvements.
4. Signage includes an 18 ft. setback to Highway 101 and County Road 6.
5. Any subsequent phases or expansions are subject to required reviews and approv-
als per Ordinance provisions.
6. All waste and waste containers shall be stored within the enclosure.
7. No Building Permit to be issued until the Final Plat is filed and recorded with
Hennepin County.
8. Appropriate legal documents and covenants, as approved by the City Attorney,
shall be recorded on the property encumbering 15 parking spaces for Lot 3, and
10 parking spaces for Lot 2, and providing for shared drive aisles.

9. The permit is issued to this facility as a gasoline service station and is subject
to all applicable codes, regulations and Ordinances, and violation thereof shall
be grounds for revocation.
10. The site shall be maintained in a sanitary manner.
11. The permit shall be reviewed in one year to assure compliance with the
conditions.
12. Com�.miance with applicable Building and Fire Code requirements shall be verified
by thL City prior to Permit issuance.
13. All parkii.-I shall he off-street in designated areas.
14. Approved variances include parking setback of 13 ft, to Highway 101; parking
setback to nuilding of 5 ft.; sign setback of 18 ft.
15. All existing structures except the convenience shopping center shall be removed as
part of the initial development, at the developer's expense, provided that the
existing service station may remain open during the development of the new
station.
. 16. There shall be no outside storage or display of merchandise.
17. The developer's insurance policy shall name the City as an additional insured
together with the "Hold Harmless" clause in the insurance policy that will be
approved by the City Attorney prior to the issuance of a Building Permit.
18. The construction site for Building B shall be fenced on all four sides with snow
fence.
19. Occupancy Permit for Buildiig B will not be issued prior to completion of
remodeling of Building C.
The motion for adoption of the foregoing Resolution was duly seconded by
Councilmember Vasiliou , and upon vote bring taken thereon, the
following voted in favor thereof: Councilmfters Crain, Neil,. Schneider and
Vasiliou
