IPPursuant to due call and notice thereof, a regular meeting of the City Council of
the City of Plymouth, Minnesota, was held on the 21St day of October , 1985,
The following members were present: Mayor Davenport. Councilmembers Crain, Neils,
Schneider and Vasiliou
The following members were absent: none

Councilmember Schneider introduced the following Resolution and moved its
adoption:
RESOLUTION NO. 85-846
APPROVING GENERAL DEVELOPMENT PLAN AMENDMENT, CONDITIONAL USE PERMIT, SITE PLAN, AND
VARIANCES FOR JAMES YUNGER (85086)
WHEREAS, James Yunger has requested approval for General Development Plan Amendment,
Conditional Use Permit, Site Plan, and Variances for the construction of an approximate
9,000 sq. ft. health and fitness center at 28th Place and Glacier Lane; and,
WHEREAS, the Planning Commission has reviewed said request at a duly called Public
Rearing and recommends approval;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MIN-
NESOTA-, that it should and hereby does approve the request by James Yunger for General
,
Development Plan Amendment, Conditional Use Permit, Site Plan, and Variances for the
construction of an approximate 9,000 s,,. ft. health and fitness center at 28th Place
and Glacier Lane, subject to the following:
1. Compliance with City Engineer's Memorandum
2. Payment of park dedication fees -in -lieu of dedication in accordance with the
Dedication Policy in effect at the time of Building Permit issuance.
3. Submission of required financial guarantee and Site Performance Agreement for
completion of site improvements.
4. All signage shall be in compliance with the Ordinance.
5. Any subsequent phases or expansions are subject to required reviews and approv-
als per Ordinance provisions.
6. All waste and waste containers shall be stored within the enclosure and no out-
side storage is permitted.
7. Approved Variances include parking setback of 17 ft. vs. 20 ft. and 109 parking
spaces vs. 200 spaces.
S. The permit is subject to all applicable codes, regulations and Ordinances, and
/ violation thereof shall be grounds for revocation.
9. The permit is issued to James Yunger, The Gym, as operator of the facility and
shall not be transferable. The facility includes free -weightlifting.

10. The site shall be maintained in a sanitary manner.
11. All parking shall be off-street in designated areas.
12. A covenant shall be filed on the property is approved by the City Attorney,
notifying that a variance related to Ordinance required parking has been
approved which may limit or restrict the future use of this site.
13. The use of this property shall not change in nature without City approval, to
include analysis of impact on parking needs and circulation.
14. On-site traffic directional signage shall be used to enhance circulation.
15. Should in the future this use no longer function in this building, the best
alternate use shall be an office.
16. The Site Plan shall be revised to direct the private driveway to Glacier Lane
and eliminate the driveway to 28th Place.
17. The General Development Plan is amended to comprehend this use in -lieu of an
office building on this site.
The motion for adoption of the foregoing Resolution was duly seconded ky
Councilmember Neils , and upon vote being taken thereon, the
following voted in favor thereof: ayor alvenport, Councilmembers Crain. Neils.
Schneider and Vasiliou
The following voted against or abstained: none
Whereupon the Resolution was declared duly passed and adopted.
