HomeMy WebLinkAboutCity Council Resolution 1985-841CITY Or PLVNMTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota, was held on the 'est day of October , 1985. The following members were present: Mayor Davenpor ounci1members Crain, Neils, Schneider and Vasiliou . The following members were absent: none �f ff• tat Councilmember Schneider introduced the following Resolution and moved its adoption: RESOLUTION NO. 85-841 APPROVING SITE PLAN, CONDITIONAL USE PERMIT AMENDMENT AND VARIANCES FOR M-NNEAPOLIS AUTO AUCTION AT 1125 NATHAN LANE (85074) WHEREAS, the Minneapolis Auto Auction has requested a Site Plan and Conditional Use Permit Amendment to allow for outside storage of automobiles and variances for unpaved vehicle storage areas at 1125 Nathan Lane; and, WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MIN- NESOTA, that it should and hereby does approve the request for Minneapolis Auto Auction for Site Plan, Conditional Use Permit Amendment and Variances to allow for outside storage of automobiles and variances for unpaved parking of vehicle storage areas at 1125 Nathan Lane, subject to the following: 1. The permit is subject to all applicable codes, regulations and Ordinances, and violation thereof shall be grounds for revocation. 2. The permit is issued to the Minneapolis Auto Auction as operator of the facility and shall not be transferable. 3. The site shall be maintained in a sanitary manner; no outside storage of trailers is permitted; and, fencing shall be used for screening along the northerly boundary. 4. The permit shall be renewed in one year to assure compliance with the conditions. 5. All parking shall be off-street in designated areas. 6. Variances include allowing parking on an unpaved surface for two years to allow soils sedimentation; also, stalls designed at 8.5 ft. x 18 ft. (rather than 9 ft. x 18.5 ft.) shall be used for vehicle storage only; all other stalls shall comply with Ordinance parking standards; a parking setback of 12 ft. and drive aisle set- back of 5 ft. rather than 20 ft. and 15 ft. respectively; and, a traffic direc- tional sign at 6 sq. ft. rather than 4 sq. ft. 7. Either appropriate legal documents/ agreements allowing for parking/drive areas to be located on the adjoining property to the north, as approved by the City Attorney, should be filed and recorded at Hennepin County or, the paving located north of the north property line shall be removed as part of the proposed Improvements. •Page two Resolution No. 85-841 8. At the time of annual review, a written description of Lill:: use of the property and management techniques with respect to control of the loudspeaker and traffic circulation shall he provided. Included with the written description should be a copy of all flyers used to inform customers and drivers of the appropriate circulation routes on public roadways. 9. Submission of required financial guarantee and Site Performance Agreement for completion of site improvements. 10. Site improvements and management techniques as described in September 24, 1985 correspondence shall be implemented. 11. Landscape plans shall be revised with the addition of Engleman Ivy, at an appropriate distance apart to be approved by staff and to be placed along the fence on the north property line, rather than fabric as suggested in the September 24, 1985 letter. 12. The landscaping plans shall be enhanced with additional plantings to mitigate the impact of the massive blacktop parking and storage area, and the revised plans shall be submitted to City staff for review and approval. The motion for adoption of the foregoing Resolution was duly seconded by Councilmember Vasiliou , and upon vote being taken thereon, the following voted in favor thereof: Mayor Davenport. Councilmembers_ Crain. Neils - Schneider and Vasiliou The following voted against or abstained: none . Whereupon the Resolution was declared duly passed and adopted.
