HomeMy WebLinkAboutCity Council Resolution 1985-838CITY OF PLYMOUTH Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Plymouth, Minnesota was held on the 21St day of October 1985. The following members were present-ayor Davenport, ounce mem ers rain, Neils, Schneider and Vasiliou . The following members were absent: none Councilmember Neils introduced the following Resolution and moved its adoption: RESOLUTION NO. 85-838 AUTHORIZING THE VACATION OF SIGHT EASEMENT LOT 1, BLOCK 1, PALMER CREEK ESTATES WHEREAS, a petition was received to vacate a certain sight easement on Lot 1, Block 1, Palmer Creek Estates; and WHEREAS, a public hearing with respect to said vacation was scheduled for October 21, 1985 in accordance with Minnesota Statutes 412.851 as amended; and WHEREAS, a notice of publication of said hearing was published and posted two weeks prior to the meeting of October 21, 1985; and WHEREAS, the Council did hold a public hearing on October 21, 1985 to inform any and all interested parties relevant to the vacation of said Sight Easement on Lot 1, Block 1, Palmer Creek Estates; and WHEREAS, it was determined by the City Council that said easement is not needed for public purposes; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA that the following sight easement is hereby vacated: A perpetual easement for sight distance purposes over and across that portion of the following described parcel: The west 33 feet of the North 285 feet of the SE 1/4 of the NW 1/4 of Section 11, Township 118, Range 22, except the west 16.5 feet thereof now dedicated for street purposes and except railroad right of way, together with an easement for sight purposes only over the following described portion of said Section 11: Commencing at a point along the southerly right of way line of the Minneapolis, St. Paul and Sault Ste. Marie railway distant 33 feet east of the intersection of said right of way line with the west line of the SE 1/4 of the NW 1/4 of said Section 11; thence south along a line parallel to the west line of the SE 1/4 of the NW 1/4 of said Section 11 a distance of 150 feet; thence northeasterly on a straight line to a point in said southerly right of way line distance 150 feet east of the point of beginning; thence west along said southerly right of way line to the point of beginning. Said vacation shall not be filed at Hennepin County until the City has received from the owner of Lot 1, Block 1, Palmer Creek Estates r sight easement for the westerly 35 feet of said lot. The motion for the adoption of the foregoing Resolution was duly seconded by Councilmember Crain , and upon vote being taken thereon, the following voted in favor thereof: Mayor Davenport, Councilmembers, Crain, Neils, Schneider and Vasiliou The following voted against or abstained: none Whereupon the Resolution was declared duly passed and adopted.
